HB 114 LC 9 7986 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 2 of Chapter 5 of Title 21 of the Official 1- 2 Code of Georgia Annotated, relating to campaign 1- 3 contributions, so as to prohibit contributions by foreign 1- 4 nationals; to provide for definitions; to repeal conflicting 1- 5 laws; and for other purposes. 1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 7 Article 2 of Chapter 5 of Title 21 of the Official Code of 1- 8 Georgia Annotated, relating to campaign contributions, is 1- 9 amended by adding at the end of said article a new Code 1-10 Section 21-5-37 to read as follows: 1-11 "21-5-37. (Index) 1-12 (a) As used in this Code section, the term: 1-13 (1) 'Foreign principal' means: 1-14 (A) A government of a foreign country or a foreign 1-15 political party; 1-16 (B) A person outside the United States, unless it is 1-17 established that such person is not an individual and 1-18 is organized under or created by the laws of the 1-19 United States or of any state or other place subject 1-20 to the jurisdiction of the United States and has its 1-21 principal place of business within the United States; 1-22 or 1-23 (C) A partnership, association, corporation, 1-24 organization, or other combination of persons 1-25 organized under the laws of or having its principal 1-26 place of business in a foreign country. 1-27 (2) 'Foreign national' means: 1-28 (A) A foreign principal, except that such term shall 1-29 not include any individual who is a citizen of the 1-30 United States; or -1- (Index) LC 9 7986 2- 1 (B) An individual who is not a citizen of the United 2- 2 States and who is not lawfully admitted to the United 2- 3 States for permanent residence as defined by 8 U.S.C., 2- 4 Section 1101(a)(20). 2- 5 (b) It shall be unlawful for a foreign national directly 2- 6 or through any other person to make any contribution of 2- 7 money or other thing of value, or to promise expressly or 2- 8 impliedly to make any such contribution, in connection 2- 9 with an election to any political office or in connection 2-10 with any primary election, convention, or caucus held to 2-11 select candidates for any political office or for any 2-12 person to solicit, accept, or receive any such 2-13 contribution from a foreign national." SECTION 2. 2-14 All laws and parts of laws in conflict with this Act are 2-15 repealed. -2- (Index)
