HB 1179 LC 11 8808 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Chapter 9 of Title 32 of the Official Code of 1- 2 Georgia Annotated, relating to mass transportation, so as to 1- 3 authorize certain public agencies, public bodies corporate, 1- 4 public corporations, and public authorities to provide 1- 5 transit services or transit facilities by contract to 1- 6 counties, municipalities, or political subdivisions; to 1- 7 provide for legislative purpose; to provide an effective 1- 8 date; to repeal conflicting laws; and for other purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Chapter 9 of Title 32 of the Official Code of Georgia 1-11 Annotated, relating to mass transportation, is amended by 1-12 adding at the end a new Code section to read as follows: 1-13 "32-9-11. (Index) 1-14 (a) As used in this Code section, the term: 1-15 (1) 'Local government' means any county, municipality, 1-16 or political subdivision of this state, or any 1-17 combination thereof. 1-18 (2) 'Transit agency' means any public agency, public 1-19 corporation, or public authority existing under the laws 1-20 of this state that is authorized by any general, 1-21 special, or local law to provide any type of transit 1-22 services within any area of this state. 1-23 (3) 'Transit facilities' means everything necessary and 1-24 appropriate for the conveyance and convenience of 1-25 passengers who utilize transit services. 1-26 (4) 'Transit services' means all modes of transportation 1-27 serving the general public which are appropriate to 1-28 transport people and their personal effects by highway, 1-29 rail, or other ground or fixed guideway conveyance. 1-30 (b) Any transit agency may, by contract with any local 1-31 government for any period not exceeding 50 years, provide -1- (Index) LC 11 8808 2- 1 transit services or transit facilities for, to, or within 2- 2 that local government or between that local government and 2- 3 any area in which such transit agency provides transit 2- 4 services or transit facilities. 2- 5 (c) The purpose of this Code section is to facilitate the 2- 6 exercise of the power to provide public transportation 2- 7 services conferred by Article IX, Section II, Paragraph 2- 8 III of the Constitution. This Code section does not 2- 9 repeal any other law conferring the power to provide 2-10 public transportation services or prescribing the manner 2-11 in which such power is to be exercised." SECTION 2. 2-12 This Act shall become effective upon its approval by the 2-13 Governor or upon its becoming law without such approval. SECTION 3. 2-14 All laws and parts of laws in conflict with this Act are 2-15 repealed. -2- (Index)
