A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 2 of Chapter 4 of Title 17 of the Official
1- 2 Code of Georgia Annotated, relating to arrest by law
1- 3 enforcement officers generally, so as to change the
1- 4 provisions relating to notice to accused of time and place
1- 5 of commitment hearing; to repeal conflicting laws; and for
1- 6 other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 8 Article 2 of Chapter 4 of Title 17 of the Official Code of
1- 9 Georgia Annotated, relating to arrest by law enforcement
1-10 officers generally, is amended by striking in its entirety
1-11 Code Section 17-4-26, relating to duty to bring persons
1-12 arrested before judicial officer within 72 hours, and
1-13 inserting in lieu thereof a new Code Section 17-4-26 to read
1-14 as follows:
1-15 "17-4-26. (Index)
1-16 Every law enforcement officer arresting under a warrant
1-17 shall exercise reasonable diligence in bringing the person
1-18 arrested before the judicial officer authorized to
1-19 examine, commit, or receive bail and in any event to
1-20 present the person arrested before a committing judicial
1-21 officer within 72 hours after arrest. The arresting
1-22 officer accused shall notify the accused be notified
1-23 when and where the commitment hearing is to be held. An
1-24 arrested person who is not notified before the hearing of
1-25 the time and place of the commitment hearing shall be
1-26 released."
SECTION 2.
1-27 All laws and parts of laws in conflict with this Act are
1-28 repealed.
