HB 1218 HB 1218/AP H. B. No. 1218 (AS PASSED HOUSE AND SENATE) By: Representatives Simpson of the 101st and Stallings of the 100th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 1 of Chapter 6 of Title 15 of the Official 1- 2 Code of Georgia Annotated, relating to general provisions 1- 3 relative to the superior courts, so as to provide for an 1- 4 exception to the pay schedule for a person appointed on or 1- 5 after a specified date as secretary to a superior court 1- 6 judge if such secretary has previously been employed as a 1- 7 secretary to a state court judge; to provide for an 1- 8 additional pay step for such secretaries in certain 1- 9 circumstances; to provide for an exception to the pay 1-10 schedule for a person appointed on or after a specified date 1-11 as secretary to a superior court judge if such secretary has 1-12 previously been employed as a secretary to a district 1-13 attorney in certain circumstances; to provide for related 1-14 matters; to repeal conflicting laws; and for other purposes. 1-15 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-16 Article 1 of Chapter 6 of Title 15 of the Official Code of 1-17 Georgia Annotated, relating to general provisions relative 1-18 to the superior courts, is amended by striking in its 1-19 entirety paragraph (5) of subsection (c) of Code Section 1-20 15-6-25, relating to employment of secretaries for judges of 1-21 the superior court, and inserting in lieu thereof the 1-22 following: 1-23 "(5) Each new secretary appointed after July 1, 1985, 1-24 shall be placed on Step 1 of the pay schedule in effect 1-25 on the date of appointment; provided, however, that: 1-26 (A) A a secretary employed under Code Section 1-27 15-18-17, authorizing the employment of district 1-28 attorney's secretaries, may transfer to this pay 1-29 schedule upon appointment as a secretary to a judge of 1-30 the superior court at the step equal to the current 1-31 salary being received if no interruption in state 1-32 employment occurs as a result of the appointment; H. B. No. 1218 -1- (Index) HB 1218/AP 2- 1 (B) A secretary employed as secretary to a state court 2- 2 judge in this state before appointment pursuant to 2- 3 this Code section may transfer to this pay schedule 2- 4 after appointment pursuant to this Code section at the 2- 5 step which is closest to but not lower than the 2- 6 highest salary received in such secretary's previous 2- 7 employment as secretary to a judge of the state court 2- 8 if such secretary was appointed pursuant to this Code 2- 9 section on or after July 1, 1995, and there was no 2-10 interruption in employment as a result of such 2-11 appointment; 2-12 (C) A secretary employed under authority other than 2-13 Code Section 15-18-17 as a secretary to a district 2-14 attorney in this state before appointment pursuant to 2-15 this Code section who was appointed on or after July 2-16 1, 1995, may transfer to this pay schedule at the step 2-17 which is closest to but not lower than the highest 2-18 salary received in such secretary's previous 2-19 employment as a secretary to a district attorney after 2-20 appointment pursuant to this Code section if there was 2-21 no interruption in employment as a result of such 2-22 appointment; and 2-23 (D) A secretary who meets the criteria of subparagraph 2-24 (B) of this paragraph and who has worked for at least 2-25 two years for a state court judge whose duties 2-26 included hearings in state court and superior court 2-27 shall receive an additional pay step above the 2-28 compensation resulting from the application of 2-29 subparagraph (B)." SECTION 2. 2-30 All laws and parts of laws in conflict with this Act are 2-31 repealed. H. B. No. 1218 -2- (Index)
