HB 1259 LC 24 0268 A BILL TO BE ENTITLED AN ACT 1- 1 To amend an Act creating a new charter for the City of 1- 2 LaGrange, Georgia, approved March 8, 1968 (Ga. L. 1968, p. 1- 3 2191), as amended, particularly by an Act approved April 5, 1- 4 1994 (Ga. L. 1994, p. 4617), so as to authorize the creation 1- 5 or abolition by ordinance of a grievance and appeals board 1- 6 to hear and determine certain personnel issues and to fix 1- 7 the procedure, rules, and regulations therefor; to authorize 1- 8 the grievance appeals board to issue subpoenas to compel 1- 9 attendance of witnesses and production of documents and to 1-10 provide for the enforcement of the subpoena by the judge of 1-11 the State Court of Troup County, Georgia; to provide for 1-12 related matters; to provide for an effective date; to repeal 1-13 conflicting laws; and for other purposes. 1-14 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-15 An Act creating a new charter for the City of LaGrange, 1-16 Georgia, approved March 8, 1968 (Ga. L. 1968, p. 2191), as 1-17 amended, particularly by an Act approved April 5, 1994 (Ga. 1-18 L. 1994, p. 4617), is amended by striking Section 2.18 1-19 thereof and inserting a new Section 2.18 to read as follows: 1-20 "SECTION 2.18. 1-21 Inquiries and investigations. 1-22 (a) The mayor and council may make inquiries and 1-23 investigations into the affairs of the city and conduct of 1-24 any department, office, or agency thereof and for this 1-25 purpose may subpoena witnesses, administer oaths, take 1-26 testimony, and require the production of evidence. Any 1-27 person who fails or refuses to obey a lawful order issued 1-28 in the exercise of these powers by the mayor and council 1-29 shall be punished as provided by ordinance. 1-30 (b) The mayor and council of the City of LaGrange are 1-31 hereby authorized to create or to abolish, by ordinance, a 1-32 grievance and appeals board for the city to hear, 1-33 determine, and decide personnel issues as defined therein; -1- (Index) LC 24 0268 2- 1 to fix the number of, qualifications, and terms for 2- 2 membership on such board; and to fix the rules, 2- 3 regulations, policies, and procedures for the grievance 2- 4 appeals board. 2- 5 (c) The grievance appeals board may, by ordinance, be 2- 6 authorized to issue subpoenas to require the attendance of 2- 7 witnesses or the production of documentary or other 2- 8 evidence, to fix a standard witness fee, and to provide 2- 9 for the enforcement of such subpoena by the judge of the 2-10 State Court of Troup County, Georgia, upon petition by the 2-11 city manager or any other party filing the petition, 2-12 including but not limited to assessment of attorney's fees 2-13 and costs for filing such petition." SECTION 2. 2-14 This Act shall become effective upon its approval by the 2-15 Governor or upon its becoming law without such approval. SECTION 3. 2-16 All laws and parts of laws in conflict with this Act are 2-17 repealed. -2- (Index)
