HB 129 HB 129/AP H. B. No. 129 (AS PASSED HOUSE AND SENATE) By: Representatives Baker of the 70th, Bordeaux of the 151st and Orrock of the 56th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Title 20 of the Official Code of Georgia Annotated, 1- 2 relating to education, so as to change provisions relating 1- 3 to educational funding; to provide for a construction 1- 4 reserve trust fund; to provide that lottery funds for new 1- 5 capital construction projects for educational purposes may 1- 6 be appropriated to such fund; to provide for the periods of 1- 7 time within which funds so appropriated must be designated 1- 8 and contractually obligated; to state legislative intent 1- 9 with respect to program weights; to provide for a change in 1-10 the program weights allotted to state authorized 1-11 instructional programs for purposes of the Quality Basic 1-12 Education Formula; to change provisions relating to funding 1-13 of salaries of superintendents, administrative personnel, 1-14 and visiting teachers; to provide for related matters; to 1-15 provide an effective date; to repeal conflicting laws; and 1-16 for other purposes. 1-17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-18 Title 20 of the Official Code of Georgia Annotated, relating 1-19 to education, is amended by adding at the end of Article 1 1-20 of Chapter 1 a new Code Section 20-1-8 to read as follows: 1-21 "20-1-8. (Index) 1-22 Any lottery funds appropriated for purposes of new capital 1-23 construction shall be placed in a Construction Reserve 1-24 Trust Fund to be maintained by the appropriate fiscal 1-25 officers of state government. Funds so placed in the 1-26 Construction Reserve Trust Fund shall be deemed to be 1-27 committed for educational purposes and programs in 1-28 compliance with subsection (d) of Code Section 50-27-13. 1-29 Any such funds must be designated by project by the 1-30 appropriate educational agency no later than June 30 of 1-31 the fiscal year for which the funds were appropriated. Any 1-32 such funds must be contractually obligated no later than 1-33 June 30 of the fiscal following the fiscal year for which H. B. No. 129 -1- (Index) HB 129/AP 2- 1 the funds were appropriated. Any funds not designated or 2- 2 contractually obligated within such time periods shall 2- 3 lapse; and additionally any funds not expended as 2- 4 originally designated and obligated within 24 months after 2- 5 the close of the fiscal year for which such funds were 2- 6 originally appropriated shall lapse. Any funds so lapsing 2- 7 shall lapse to the general fund of the state treasury and 2- 8 shall be credited to the Lottery for Education Account." SECTION 2. 2- 9 (a) The General Assembly finds and determines that certain ---------------------------------------- `@P 2-11 state authorized instructional programs for purposes of the 2-12 Quality Basic Education Formula. This section accordingly 2-13 provides for the assignment of certain program weights which 2-14 shall apply beginning July 1, 1995. 2-15 (b) Said Title 20 is further amended by striking subsection 2-16 (b) of Code Section 20-2-161, relating to the Quality Basic 2-17 Education Formula, in its entirety and inserting in its 2-18 place a new subsection (b) to read as follows: 2-19 "(b) As the cost of instructional programs varies 2-20 depending upon the teacher-student ratios and specific 2-21 services typically required to address the special needs 2-22 of students enrolled, state authorized instructional 2-23 programs shall have the following program weights: 2-24 (1) Kindergarten program.................. 1.338 1.3286 2-25 (2) Primary grades program (1-3).......... 1.257 1.2432 2-26 (3) Upper elementary grades program (4-5). 1.016 1.0197 2-27 (4) Middle grades program (6-8)........... 1.019 1.0242 2-28 (5) High school general education program 2-29 (9-12)........................................... 1.000 2-30 (6) High school nonvocational 2-31 laboratory program (9-12)................. 1.242 1.2428 2-32 (7) Vocational laboratory program (9-12).. 1.343 1.3557 2-33 (8) Program for the handicapped: 2-34 Category I................................ 2.270 2.3419 2-35 (9) Program for the handicapped: 2-36 Category II............................... 2.612 2.7204 2-37 (10) Program for the handicapped: 2-38 Category III.............................. 3.307 3.4579 H. (Index) 3-12 All program weights, when multiplied by the base amount, 3-13 shall reflect sufficient funds to pay the beginning 3-14 salaries of a superintendent regardless of system size, 3-15 assistant superintendents, and a visiting teacher as well 3-16 as the salaries of secretaries and an accountant essential 3-17 for the efficient and effective management of all 3-18 instructional and supportive educational programs of a 3-19 base size local school system pursuant to Code Section 3-20 20-2-181 and to provide for the costs of operating an 3-21 administrative office for the local school system and for 3-22 workers' compensation and employment security payments for 3-23 personnel at the central office, school, and program 3-24 levels, subject to appropriation by the General Assembly. 3-25 Further, the program weights for all special education 3-26 programs pursuant to Code Section 20-2-152, when 3-27 multiplied by the base amount, shall reflect sufficient 3-28 funds to pay the beginning salaries of special education 3-29 leadership personnel essential and necessary for the 3-30 effective operation of such programs in a base size local 3-31 school system. Further, the program weights for all 3-32 programs, when multiplied by the base amount, shall 3-33 reflect sufficient funds to pay the beginning salaries of 3-34 school psychologists and psychometrists essential and 3-35 necessary for the effective operation of such programs in 3-36 a base size local school system, subject to appropriation 3-37 by the General Assembly.", 3-38 and inserting in its place a new Code section to read as 3-39 follows: H. B. No. 129 -3- (Index) HB 129/AP 4- 1 "20-2-186. (Index) 4- 2 Funds provided under this article shall include the 4- 3 following for local systems to pay the beginning salaries 4- 4 of superintendents, secretaries, and accountants, subject 4- 5 to appropriation by the General Assembly: 4- 6 (1) Each local system shall earn, for any number of 4- 7 full-time equivalent students equal to or under 1,000, 4- 8 funds sufficient to pay the beginning salaries of a 4- 9 superintendent, accountant, and one-half the salary of a 4-10 secretary; and 4-11 (2) For numbers of full-time equivalent students over 4-12 1,000 and less than 2,001, 80 percent of the amount 4-13 obtained by multiplying the number of students over 4-14 1,000 by the amount earned in paragraph (1) of this Code 4-15 section divided by 1,000; and 4-16 (3) For numbers of full-time equivalent students over 4-17 2,000 and less than 3,001, 70 percent of the amount 4-18 obtained by multiplying the number of students over 4-19 2,000 by the amount earned in paragraph (1) of this Code 4-20 section divided by 1,000; and 4-21 (4) For numbers of full-time equivalent students over 4-22 3,000 and less than 4,001, 60 percent of the amount 4-23 obtained by multiplying the number of students over 4-24 3,000 by the amount earned in paragraph (1) of this Code 4-25 section divided by 1,000; and 4-26 (5) For numbers of full-time equivalent students over 4-27 4,000 and less than 10,001, 33 percent of the amount 4-28 obtained by multiplying the number of students over 4-29 4,000 by the amount earned in paragraph (1) of this Code 4-30 section divided by 1,000; and 4-31 (6) For numbers of full-time equivalent students over 4-32 10,000, an amount equal to 25 percent of the amount 4-33 obtained by multiplying the number of students over 4-34 10,000 by the amount earned in paragraph (1) of this 4-35 Code section divided by 1,000. 4-36 All program weights, when multiplied by the base amount, 4-37 shall reflect sufficient funds to pay the beginning 4-38 salaries of a visiting teacher for a base size school 4-39 system pursuant to Code Section 20-2-181 and for costs of 4-40 operating an administrative office for the local school 4-41 system and for workers' compensation and employment 4-42 security payments for personnel at the central office, H. B. No. 129 -4- (Index) HB 129/AP 5- 1 school, and program levels, subject to appropriation by 5- 2 the General Assembly. Further, the program weights for 5- 3 all special education programs pursuant to Code Section 5- 4 20-2-152, when multiplied by the base amount, shall 5- 5 reflect sufficient funds to pay the beginning salaries of 5- 6 special education leadership personnel essential and 5- 7 necessary for the effective operation of such programs in 5- 8 a base size local school system. Further, the program 5- 9 weights for all programs, when multiplied by the base 5-10 amount, shall reflect sufficient funds to pay the 5-11 beginning salaries of school psychologists and 5-12 psychometrists essential and necessary for the effective 5-13 operation of such programs in a base size local school 5-14 system, subject to appropriation by the General Assembly." SECTION 4. 5-15 Section 1 of this Act shall become effective upon approval 5-16 of this Act by the Governor or upon this Act's becoming law 5-17 without such approval; and Section 1 of this Act shall apply 5-18 with respect to appropriations for the fiscal year ending 5-19 June 30, 1995, as well as all future fiscal years. Sections 5-20 2 and 3 of this Act shall become effective on July 1, 1995. SECTION 5. 5-21 All laws and parts of laws in conflict with this Act are 5-22 repealed. H. B. No. 129 -5- (Index)
