HB 130 LC 22 1322 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 1 of Chapter 16 of Title 50 of the Official 1- 2 Code of Georgia Annotated, relating to general provisions 1- 3 relative to public property, so as to provide that contracts 1- 4 for the use of a public stadium, auditorium, or arena shall 1- 5 provide that use of a mascot referring to a racial or ethnic 1- 6 group or sale of items relating to such a mascot constitutes 1- 7 breach of the contract; to provide for definitions and 1- 8 construction; to provide for related matters; to repeal 1- 9 conflicting laws; and for other purposes. 1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-11 Article 1 of Chapter 16 of Title 50 of the Official Code of 1-12 Georgia Annotated, relating to general provisions relative 1-13 to public property, is amended by inserting a new Code 1-14 section to be designated Code Section 50-16-19 to read as 1-15 follows: 1-16 "50-16-19. (Index) 1-17 (a) For the purposes of this Code section, the term: 1-18 (1) 'Mascot' includes a symbol, emblem, logo, 1-19 representation, token, figure, or personification used 1-20 to represent a sports team; and 1-21 (2) 'Public stadium, auditorium, or arena' means a 1-22 stadium, auditorium, or arena constructed, acquired, or 1-23 operated with the proceeds of bonds issued by or funds 1-24 allocated or appropriated to a department, agency, 1-25 authority, or instrumentality of the state or of a 1-26 political subdivision of the state. 1-27 (b) After the effective date of this Code section, the 1-28 operators or managers of a public stadium, auditorium, or 1-29 arena in contracting for the use of that public stadium, 1-30 auditorium, or arena shall provide in such contracts that 1-31 the following conduct will constitute a breach of the 1-32 contract: -1- (Index) LC 22 1322 2- 1 (1) Use in the stadium, arena, or auditorium by a sports 2- 2 team of an official mascot which makes reference to a 2- 3 racial or ethnic group; or 2- 4 (2) Sale by a vendor in the stadium, arena, or 2- 5 auditorium of items relating to a mascot which makes 2- 6 reference to a racial or ethnic group. 2- 7 (c) This Code section shall not be construed to impair 2- 8 contracts in existence on the effective date of this Code 2- 9 section." SECTION 2. 2-10 All laws and parts of laws in conflict with this Act are 2-11 repealed. -2- (Index)
