substitute to HB 1309:
A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 10 of Title 16 of the Official Code of
1- 2 Georgia Annotated, relating to offenses against public
1- 3 administration, so as to provide for the offense of
1- 4 obstructing or hindering emergency medical professionals or
1- 5 persons working under the direction of emergency medical
1- 6 professionals; to clarify certain terms; to provide a
1- 7 definition; to provide penalties; to repeal conflicting
1- 8 laws; and for other purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-10 Chapter 10 of Title 16 of the Official Code of Georgia
1-11 Annotated, relating to offenses against public
1-12 administration, is amended in Article 2 by striking in its
1-13 entirety Code Section 16-10-24.2, relating to obstructing or
1-14 hindering emergency medical technicians, and inserting in
1-15 lieu thereof the following:
1-16 "16-10-24.2. (Index)
1-17 (a) As used in this Code section, the term:
1-18 (1) 'Emergency medical technician' means any person who
1-19 has been certified as an emergency medical technician,
1-20 cardiac technician, paramedic, or first responder
1-21 pursuant to Chapter 11 of Title 31.
1-22 (2) 'Emergency medical professional' means any person
1-23 performing emergency medical services who is licensed or
1-24 certified to provide health care in accordance with the
1-25 provisions of Chapter 11, Chapter 26, or Chapter 34 of
1-26 Title 43.
1-27 (b) Except as otherwise provided in subsection (c) of this
1-28 Code section, a person who knowingly and willfully
1-29 obstructs or hinders any emergency medical technician, any
1-30 emergency medical professional, or any properly identified
1-31 person working under the direction of an emergency medical
1-32 professional in the lawful discharge of the emergency

2- 1 medical technician's official duties of such emergency
2- 2 medical technician, emergency medical professional, or
2- 3 properly identified person working under the direction of
2- 4 an emergency medical professional is guilty of a
2- 5 misdemeanor.
2- 6 (c) Whoever knowingly and willfully resists, or obstructs,
2- 7 or opposes any emergency medical technician, any emergency
2- 8 medical professional, or any properly identified person
2- 9 working under the direction of an emergency medical
2-10 professional in the lawful discharge of the emergency
2-11 medical technician's official duties of the emergency
2-12 medical technician, emergency medical professional, or
2-13 properly identified person working under the direction of
2-14 an emergency medical professional by offering threatening
2-15 or doing violence to the person of such emergency medical
2-16 technician, emergency medical professional, or properly
2-17 identified person working under the direction of an
2-18 emergency medical professional is guilty of a felony and
2-19 shall, upon conviction thereof, be punished by
2-20 imprisonment for not less than one nor more than five
2-21 years."
SECTION 2.
2-22 All laws and parts of laws in conflict with this Act are
2-23 repealed.
