HB 1318 HB 1318/FA H. B. No. 1318 (AM) By: Representatives Lucas of the 124th, Polak of the 67th, Walker of the 141st, Murphy of the 18th and Lee of the 94th A BILL TO BE ENTITLED AN ACT 1- 1 To amend Chapter 2 of Title 21, relating to elections and 1- 2 primaries generally, and Code Section 45-5-3, relating to 1- 3 the election or appointment of successors to fill the 1- 4 unexpired term of certain public officers, so as to provide 1- 5 for the position on the general election ballot of 1- 6 candidates to fill the unexpired term of certain offices 1- 7 elected statewide; to provide that certain special elections 1- 8 to fill the unexpired term of public officers shall be held 1- 9 in conjunction with certain general elections; to provide 1-10 for related matters; to repeal conflicting laws; and for 1-11 other purposes. 1-12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-13 Chapter 2 of Title 21, relating to elections and primaries 1-14 generally, is amended by striking in its entirety Code 1-15 Section 21-2-541, relating to holding a special primary or 1-16 election at the time of a general primary or election, and 1-17 inserting in lieu thereof the following: 1-18 "21-2-541. (Index) 1-19 (a) A special primary or election may be held at the time 1-20 of a general primary or election. 1-21 (b) If the times specified for the closing of the 1-22 registration list for a special primary or election are 1-23 the same as those for a general primary or election, the 1-24 candidates and questions in such special primary or 1-25 election may shall be included on the ballot for such 1-26 general primary or election. In such an instance, the name 1-27 of the office and the candidates in such special election 1-28 shall appear on the ballot in the position where such 1-29 names would ordinarily appear if such contest was a 1-30 general primary or election." No. 1318 -1- (Index) HB 1318/FA SECTION 2. 2- 1 Code Section 45-5-3, relating to election or appointment of 2- 2 successor to fill unexpired term of certain public officers, 2- 3 is amended by striking in its entirety subsection (b) and 2- 4 inserting in lieu thereof the following: 2- 5 "(b) When a special election is required to fill a vacancy 2- 6 for the unexpired term of office as provided by paragraph 2- 7 (2) of subsection (a) of this Code section, such special 2- 8 election shall be held on the same date as the general 2- 9 election which is first held following the date of the 2-10 vacancy and in conjunction with such general election." SECTION 3. 2-11 All laws and parts of laws in conflict with this Act are 2-12 repealed. H. B. No. 1318 -2- (Index)
