                        A BILL TO BE ENTITLED
                               AN ACT


  1- 1  To amend Chapter 1 of Title 32 of the Official Code of
  1- 2  Georgia Annotated, relating to general provisions regarding
  1- 3  highways, so as to change the prohibition regarding
  1- 4  construction or maintenance of private roads; to repeal
  1- 5  conflicting laws; and for other purposes.

  1- 6       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

                         SECTION 1.

  1- 7  Chapter 1 of Title 32 of the Official Code of Georgia
  1- 8  Annotated, relating to general provisions regarding
  1- 9  highways, is amended by striking Code Section 32-1-8,
  1-10  relating to construction and maintenance of private roads,
  1-11  and inserting in its place the following:

  1-12    "32-1-8. (Index)

  1-13    It shall be unlawful for any official, officer, or
  1-14    employee of the department, the State Tollway Authority,
  1-15    the Georgia Highway Authority, or any similar authority or
  1-16    of any county or municipality to authorize the
  1-17    construction or maintenance of any private road, but this
  1-18    prohibition shall not apply to the authorization for the
  1-19    construction or maintenance of any private road by a
  1-20    county or municipality when the full costs of such
  1-21    construction or maintenance are paid by the property owner
  1-22    to such county or municipality."

                         SECTION 2.

  1-23  All laws and parts of laws in conflict with this Act are
  1-24  repealed.
