HB 1409 LC 11 8862 A BILL TO BE ENTITLED AN ACT 1- 1 To amend an Act providing for the Magistrate Court of 1- 2 Chatham County, approved March 21, 1984 (Ga. L. 1984, p. 1- 3 4422), as amended, so as to provide for the nonpartisan 1- 4 nomination and election of the chief magistrate and 1- 5 full-time magistrates of the Magistrate Court of Chatham 1- 6 County; to provide for terms of office; to repeal 1- 7 conflicting laws; and for other purposes. 1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 9 An Act providing for the Magistrate Court of Chatham County, 1-10 approved March 21, 1984 (Ga. L. 1984, p. 4422), as amended, 1-11 is amended by adding immediately following Section 2 thereof 1-12 a new section to read as follows: 1-13 "SECTION 2.1. 1-14 Successors to the chief magistrate and full-time magistrates 1-15 of the Magistrate Court of Chatham County whose terms of 1-16 office are to expire, shall be nominated and elected by the 1-17 qualified voters of Chatham County in a nonpartisan primary 1-18 and election which shall be conducted at the time of the 1-19 state-wide primary and the November general election, 1-20 respectively, held immediately preceding the expiration of 1-21 such terms of office. Persons elected to such office shall 1-22 take office the first day of January immediately following 1-23 such election and shall serve for a term of office of four 1-24 years and until the election and qualification of their 1-25 respective successors. The procedures for such nonpartisan 1-26 primary and election shall be as provided in Code Section 1-27 21-2-139 of the O.C.G.A. Except as otherwise provided in 1-28 this Act, such magistrates shall be nominated and elected 1-29 pursuant to the applicable general election laws of this 1-30 state." -1- (Index) LC 11 8862 SECTION 2. 2- 1 All laws and parts of laws in conflict with this Act are 2- 2 repealed. -2- (Index)
