A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 2 of Title 20 of the Official Code of
1- 2 Georgia Annotated, relating to elementary and secondary
1- 3 education, so as to provide for the "Community Education
1- 4 Act"; to provide for a short title and for definitions; to
1- 5 create the Community Education Advisory Council and provide
1- 6 for its appointment, membership, duties, and compensation;
1- 7 to provide for guidelines for community education programs
1- 8 and the administration thereof; to provide for the receipt
1- 9 of funds and donations to develop and support community
1-10 education programs; to provide for grants and the conditions
1-11 thereof; to repeal conflicting laws; and for other purposes.
1-12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-13 Chapter 2 of Title 20 of the Official Code of Georgia
1-14 Annotated, relating to elementary and secondary education,
1-15 is amended by adding at the end a new article to read as
1-16 follows:
"ARTICLE 31
1-17 20-2-2050. (Index)
1-18 This article shall be known and may be cited as the
1-19 'Community Education Act.'
1-20 20-2-2051. (Index)
1-21 As used in this article, the term:
1-22 (1) 'Board of education' means the county board of
1-23 education in any county in which there is no independent
1-24 school system. In any county in which there is a county
1-25 school system and one or more independent school
1-26 systems, 'board of education' means the board of
1-27 education designated by written agreement of all boards
1-28 of education within the county to coordinate the
1-29 community education program within the county.

2- 1 (2) 'Community education coordinator' means an employee
2- 2 of a local board of education whose responsibility is to
2- 3 promote and direct the implementation of a local
2- 4 community education program.
2- 5 (3) 'Community education program' means a program
2- 6 designed to collaborate efforts of local school systems,
2- 7 public agencies, service organizations, and private
2- 8 businesses to provide easily accessible educational,
2- 9 social, cultural, recreational, and other services for
2-10 all citizens in accordance with the needs, interests,
2-11 and concerns of local communities. School facilities
2-12 may be used as community resource centers to facilitate
2-13 community education programs.
2-14 (4) 'Department' means the State Department of
2-15 Education.

2-17 There shall be created a state-wide Community Education
2-18 Advisory Council to be composed of the State School
2-19 Superintendent or the designee thereof, two local
2-20 community education coordinators, and at least ten but not
2-21 more than 15 other members from public agencies, private
2-22 business, and community leaders. The State School
2-23 Superintendent shall appoint the two local community
2-24 education coordinators and three other members of the
2-25 council. The Governor or the Governor's designee shall
2-26 appoint the remaining members of the council. Appointed
2-27 members of the council shall serve without compensation
2-28 and shall serve at the pleasure of the officer who
2-29 appointed them. The council shall advise the State Board
2-30 of Education and the department concerning community
2-31 education programs and shall assist local boards of
2-32 education with developing, implementing, operating, and
2-33 improving local programs.

2-35 The State Board of Education and the department shall
2-36 establish guidelines for developing and implementing local
2-37 community education programs. Such guidelines shall
2-38 include regulations for submission and approval of
2-39 proposals by local boards of education and the evaluation
2-40 of the effectiveness of local programs. The department
2-41 shall appoint an administrator to work with local systems
2-42 in establishing and implementing programs.

3- 2 The State Board of Education and the department are
3- 3 authorized to accept and expend state, federal, and
3- 4 private funds, including gifts, grants, and bequests from
3- 5 any person, corporation, partnership, association, or
3- 6 other entity to administer this article for the purpose of
3- 7 developing and supporting community education programs
3- 8 throughout this state. From funds appropriated or
3- 9 otherwise available for such purpose, the State Board of
3-10 Education is authorized to make grants to local boards of
3-11 education for the creation, administration, operation, and
3-12 coordination of community education activities. Such
3-13 grants shall be made and the funds shall be administered
3-14 and expended subject to this article and the rules and
3-15 regulations of the State Board of Education adopted
3-16 pursuant to this article.

3-18 To be eligible for receiving community education funds
3-19 from the State Board of Education, pursuant to Code
3-20 Section 20-2-2044, local boards of education may:
3-21 (1) Adopt a resolution to support the implementation and
3-22 funding of a community education program within the
3-23 county; and
3-24 (2) Establish a community education advisory council
3-25 within the county to assist and advise the board of
3-26 education and the community education personnel. Such
3-27 advisory council shall involve governmental and
3-28 community service agencies, the business community, and
3-29 private citizens in planning and implementing the
3-30 community education program."
SECTION 2.
3-31 All laws and parts of laws in conflict with this Act are
3-32 repealed.
