A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 4 of Title 32 of the Official Code of
1- 2 Georgia Annotated, relating to state, county, and municipal
1- 3 road systems, so as to provide for an increase in the amount
1- 4 for which a county may execute a negotiated contract; to
1- 5 provide for an increase in the amount for which a
1- 6 municipality may execute a negotiated contract; to repeal
1- 7 conflicting laws; and for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 9 Chapter 4 of Title 32 of the Official Code of Georgia
1-10 Annotated, relating to state, county, and municipal road
1-11 systems, is amended by striking Code Section 32-4-63,
1-12 relating to limitations on a county's power to contract, and
1-13 inserting in lieu thereof a new Code Section 32-4-63 to read
1-14 as follows:
1-15 "32-4-63. (Index)
1-16 A county is prohibited from negotiating a contract except
1-17 a contract:
1-18 (1) Involving the expenditure of less than $20,000.00
1-19 $50,000.00;
1-20 (2) With a state agency or county or municipality with
1-21 which a county is authorized to contract in accordance
1-22 with the provisions of Code Sections 32-4-61 and
1-23 32-4-62;
1-24 (3) For the purchase of those materials, supplies, and
1-25 equipment necessary for the county's construction and
1-26 maintenance of its public roads and for the support and
1-27 maintenance of the county's forces used in such work, as
1-28 authorized by Code Section 36-10-4;
1-29 (4) Subject to Article 6 of Chapter 6 of this title,
1-30 with a railroad or railway company or a publicly or
1-31 privately owned utility concerning relocation of its

2- 1 line, tracks, or facilities where the same are not then
2- 2 located in a public road and such relocation or
2- 3 grade-crossing elimination is necessary as an incident
2- 4 to the construction of a new public road or to the
2- 5 reconstruction or maintenance of an existing public
2- 6 road. Nothing contained in this paragraph shall be
2- 7 construed as requiring a county to furnish a site or
2- 8 right of way for railroad or railway lines or tracks of
2- 9 public utility facilities required to be removed from a
2-10 public road;
2-11 (5) For engineering or other kinds of professional or
2-12 specialized services;
2-13 (6) For emergency maintenance requiring immediate
2-14 repairs to a public road, including but not limited to
2-15 bridge repairs, snow and ice removal, and repairs due to
2-16 flood conditions; or
2-17 (7) Otherwise expressly authorized by law."
SECTION 2.
2-18 Said chapter is further amended by striking Code Section
2-19 32-4-113, relating to limitations on a municipality's power
2-20 to contract, and inserting in lieu thereof a new Code
2-21 Section 32-4-113 to read as follows:
2-22 "32-4-113. (Index)
2-23 A municipality is prohibited from negotiating a contract
2-24 except a contract:
2-25 (1) Involving the expenditure of less than $20,000.00
2-26 $50,000.00;
2-27 (2) With a state agency or political subdivision as
2-28 authorized by Code Sections 32-4-111 and 32-4-112;
2-29 (3) With a railroad or railway company or a publicly or
2-30 privately owned utility as authorized by Article 6 of
2-31 Chapter 6 of this title;
2-32 (4) For engineering or other kinds of professional or
2-33 specialized services;
2-34 (5) For emergency maintenance requiring immediate
2-35 repairs to a public road, including but not limited to
32-4-63 32-4-113 N snow and ice removal, and repairs due to
2-37 flood conditions; or
2-38 (6) Otherwise expressly authorized by law."

SECTION 3.
3- 1 All laws and parts of laws in conflict with this Act are
3- 2 repealed.
