A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Title 21 of the Official Code of Georgia Annotated,
1- 2 relating to elections, so as to redefine the term "absentee
1- 3 elector" to provide that persons who are unable to be
1- 4 present at the polls on election day because such persons
1- 5 are providing care to a physically disabled person may
1- 6 qualify as absentee electors; to repeal conflicting laws;
1- 7 and for other purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 9 Title 21 of the Official Code of Georgia Annotated, relating
1-10 to elections, is amended by striking Code Section 21-2-380,
1-11 relating to the definition of the term "absentee elector,"
1-12 in its entirety and inserting in lieu thereof a new Code
1-13 Section 21-2-380 to read as follows:
1-14 "21-2-380. (Index)
1-15 As used in this article, the term 'absentee elector' means
1-16 an elector of this state who:
1-17 (1) Is required to be absent from his or her precinct
1-18 during the time of the primary or election he or she
1-19 desires to vote in;
1-20 (2) Will perform any of the official acts or duties set
1-21 forth in this chapter in connection with the primary or
1-22 election he or she desires to vote in;
1-23 (3) Because of physical disability or because of being
1-24 required to give constant care to someone who is
1-25 physically disabled, will be unable to be present at the
1-26 polls on the day of such primary or election;
1-27 (4) Because the election or primary falls upon a
1-28 religious holiday observed by such elector, will be
1-29 unable to be present at the polls on the day of such
1-30 primary or election;

2- 1 (5) Is required to remain on duty in his or her place of
2- 2 employment for the protection of the health, life, or
2- 3 safety of the public during the entire time the polls
2- 4 are open when such place of employment is within the
2- 5 precinct in which the voter resides; or
2- 6 (6) Is 75 years of age or older."
SECTION 2.
2- 7 Said title is further amended by striking Code Section
2- 8 21-3-280, relating to the definition of the term "absentee
2- 9 elector," in its entirety and inserting in lieu thereof a
2-10 new Code Section 21-3-280 to read as follows:
2-11 "21-3-280. (Index)
2-12 As used in this article, the term 'absentee elector' means
2-13 an elector of the municipality who:
2-14 (1) Is required to be absent from his or her precinct
2-15 during the time of the primary or election in which he
2-16 or she desires to vote;
2-17 (2) Will perform any of the official acts or duties set
2-18 forth in this chapter in connection with the primary or
2-19 election in which he or she desires to vote;
2-20 (3) Because of physical disability or because of being
2-21 required to give constant care to someone who is
2-22 physically disabled, will be unable to be present at the
2-23 polls on the day of such primary or election;
2-24 (4) Because the election or primary falls upon a
2-25 religious holiday observed by such elector, will be
2-26 unable to be present at the polls on the day of such
2-27 primary or election;
2-28 (5) Is required to remain on duty in his or her place of
2-29 employment for the protection of the health, life, or

SECTION 3.
2-34 All laws and parts of laws in conflict with this Act are
2-35 repealed.
