HB 1539 LC 24 0462S A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 30-5-4 of the Official Code of Georgia 1- 2 Annotated, relating to reporting the need for protective 1- 3 services for disabled adults, so as to change which persons 1- 4 must make certain reports; to provide for reporting the need 1- 5 for protective services for elderly adults; to repeal 1- 6 conflicting laws; and for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Code Section 30-5-4 of the Official Code of Georgia 1- 9 Annotated, relating to reporting the need for protective 1-10 services for disabled adults, is amended by striking 1-11 paragraph (1) of subsection (a) thereof and inserting in 1-12 lieu thereof the following: 1-13 "(a)(1) Any physician, osteopath, intern, resident, 1-14 other hospital or medical personnel, dentist, 1-15 psychologist, podiatrist, nursing personnel, social work 1-16 personnel, day-care personnel, or law enforcement 1-17 personnel, or any other person providing services having 1-18 reasonable cause to believe that a disabled or elderly 1-19 adult has had a physical injury or injuries inflicted 1-20 upon him such disabled or elderly adult, other than by 1-21 accidental means, by a caretaker or has been neglected 1-22 or exploited by a caretaker shall report or cause 1-23 reports to be made in accordance with the provisions of 1-24 this Code section. Any employee of a financial 1-25 institution, as defined in Code Section 7-1-4, having 1-26 reasonable cause to believe that a disabled or elderly 1-27 adult has been exploited by a caretaker shall report or 1-28 cause reports to be made in accordance with the 1-29 provisions of this Code section. When ; provided, 1-30 however, that, when the person having a reasonable cause 1-31 to believe that a disabled or elderly adult is in need 1-32 of protective services performs services as a member of 1-33 the staff of a hospital, social agency, financial 1-34 institution, or similar facility, he such person shall -1- (Index) LC 24 0462S 2- 1 notify the person in charge of the facility and such 2- 2 person or his that person's designee shall report or 2- 3 cause reports to be made in accordance with the 2- 4 provisions of this Code section." SECTION 2. 2- 5 All laws and parts of laws in conflict with this Act are 2- 6 repealed. -2- (Index)
