A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 2 of Chapter 8 of Title 50 of the Official
1- 2 Code of Georgia Annotated, relating to regional development
1- 3 centers, so as to change the provisions regarding membership
1- 4 in, dues for, and funding of such centers; to repeal
1- 5 conflicting laws; and for other purposes.
1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 7 Article 2 of Chapter 8 of Title 50 of the Official Code of
1- 8 Georgia Annotated, relating to regional development centers,
1- 9 is amended by striking Code Section 50-8-33, relating to
1-10 membership in such centers, and inserting in its place the
1-11 following:

1-13 (a) Each municipality and county in the state which pays
1-14 its annual membership dues shall automatically be a member
1-15 of the regional development center for the region which
1-16 includes the municipality or county, as the case may be.
1-17 (b)(1) Each county and municipality in the state shall
1-18 pay the annual dues for membership in its regional
1-19 development center. Each county and the municipalities
1-20 within such county shall continue to use the arrangement
1-21 for the payment of dues which was in effect on June 30,
1-22 1989, for the payment of dues to the area planning and
1-23 development commission which preceded the regional
1-24 development center created by this article until a
1-25 revised arrangement for the amount, apportionment, and
1-26 payment of annual dues is established by the county and
1-27 the municipalities within such county. If an
1-28 arrangement for the payment of such dues is structured
1-29 so that a county pays dues only on behalf of residents
1-30 of the unincorporated areas of the county, then the
1-31 annual dues paid by such county shall come solely from
1-32 revenues derived from the unincorporated areas of the
1-33 county. Each county and municipality is authorized but

2- 1 not required to pay annual dues to be a member in its
2- 2 regional development center.
2- 3 (2) State funds appropriated to the department and
2- 4 available for the purpose of assisting regional
2- 5 development centers shall be distributed in accordance
2- 6 with this paragraph. The department shall establish a
2- 7 minimum funding amount for regional development centers,
2- 8 conditioned upon the amount of state funds appropriated,
2- 9 and a supplemental funding formula to be used for the
2-10 distribution of available state funds in excess of the
2-11 minimum funding amount. To be eligible for the minimum
2-12 funding amount, each regional development center must
2-13 assess and collect annual dues in the amount of 25› for
2-14 each resident of each county within the regional
2-15 development center, based upon the most recent estimate
2-16 of population approved by the department for this
2-17 purpose. To be eligible for any supplemental funding,
2-18 each regional development center shall be required to
2-19 match the amount of the supplemental funds on a
2-20 dollar-for-dollar basis and shall only use for the
2-21 purpose of computing matching funds revenues of the
2-22 regional development center in excess of the amount
2-23 required for the minimum funding amount. The department
2-24 may decline to provide the minimum or supplemental state
2-25 funding, or both, to any regional development center
2-26 whose membership does not include every municipality and
2-27 county in the center's region.
2-28 (3) The initial supplemental funding formula established
2-29 by the department to be used for the distribution of
2-30 available state funds in excess of the minimum funding
2-31 amount shall be promulgated by the department in
2-32 accordance with the procedures of Code Section
2-33 50-8-7.2."
SECTION 2.
2-34 All laws and parts of laws in conflict with this Act are
2-35 repealed.
