HB 159 LC 9 7911 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Chapter 15 of Title 9 of the Official Code of 1- 2 Georgia Annotated, relating to court and litigation costs in 1- 3 civil cases, so as to provide that a plaintiff who loses at 1- 4 trial shall pay all court costs and attorney's fees; to 1- 5 provide for payment by the plaintiff's attorney of record if 1- 6 such plaintiff is unable to pay such court costs and 1- 7 attorney's fees; to provide that a subsequent reversal on 1- 8 appeal shall not affect the plaintiff's or the plaintiff's 1- 9 attorney's liability for costs and fees; to provide for 1-10 related matters; to repeal conflicting laws; and for other 1-11 purposes. 1-12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-13 Chapter 15 of Title 9 of the Official Code of Georgia 1-14 Annotated, relating to court and litigation costs in civil 1-15 cases, is amended by adding at the end thereof a new Code 1-16 Section 9-15-15 to read as follows: 1-17 "9-15-15. (Index) 1-18 In any civil action in any court of record of this state, 1-19 all attorney's fees and court costs shall be assessed 1-20 against the plaintiff in such action if judgment is 1-21 rendered against such plaintiff at trial. If the plaintiff 1-22 is unable to pay such attorney's fees and court costs, or 1-23 any portion thereof, in any such civil action, such 1-24 attorney's fees and court costs or such portion thereof 1-25 which the plaintiff is unable to pay shall be assessed 1-26 against and paid by the plaintiff's attorney. Subsequent 1-27 reversal of such judgment on appeal shall not affect 1-28 assessment of such attorney's fees and costs." SECTION 2. 1-29 All laws and parts of laws in conflict with this Act are 1-30 repealed. -1- (Index)
