HB 163 LC 18 6498 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Part 1 of Article 3 of Chapter 4 of Title 10 of the 1- 2 Official Code of Georgia Annotated, relating to leaf tobacco 1- 3 sales and storage, so as to change the maximum charges for 1- 4 handling and selling leaf tobacco by warehousemen; to 1- 5 provide for a short title; to repeal conflicting laws; and 1- 6 for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Part 1 of Article 3 of Chapter 4 of Title 10 of the Official 1- 9 Code of Georgia Annotated, relating to leaf tobacco sales 1-10 and storage, is amended by striking Code Section 10-4-106 1-11 and inserting in its place a new Code Section 10-4-106 to 1-12 read as follows: 1-13 "10-4-106. (Index) 1-14 (a) This Code section shall be known and may be cited as 1-15 'The Georgia Tobacco Marketing Act of 1995.' 1-16 (b) The maximum charges and expenses of handling and 1-17 selling leaf tobacco by warehousemen licensed under this 1-18 part shall not exceed the following schedule, to wit: 1-19 (1) For auction fees, 15› on all piles or sheets of 100 1-20 pounds or less and 25› on all piles or sheets over 100 1-21 pounds Reserved; 1-22 (2) For weighing and handling, 10› per pile or sheet for 1-23 all piles or sheets of 100 pounds or less and 10› for 1-24 each additional 100 pounds Reserved; 1-25 (3) For commissions on the gross sales of leaf tobacco 1-26 in said warehouses, not to exceed 2 3/4 3.5 percent of 1-27 said gross sales." SECTION 2. 1-28 All laws and parts of laws in conflict with this Act are 1-29 repealed. -1- (Index)
