                        A BILL TO BE ENTITLED
                               AN ACT


  1- 1  To amend an Act providing for the filling of vacancies in
  1- 2  the membership of the Hospital Authority of Floyd County,
  1- 3  approved March 1, 1973 (Ga. L. 1973, p. 2057), as amended,
  1- 4  particularly by an Act approved March 29, 1994 (Ga. L. 1994,
  1- 5  p. 4407), so as to change the manner of filling such
  1- 6  vacancies; to provide for an effective date; to repeal
  1- 7  conflicting laws; and for other purposes.

  1- 8       BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

                         SECTION 1.

  1- 9  An Act providing for the filling of vacancies in the
  1-10  membership of the Hospital Authority of Floyd County,
  1-11  approved March 1, 1973 (Ga. L. 1973, p. 2057), as amended,
  1-12  particularly by an Act approved March 29, 1994 (Ga. L. 1994,
  1-13  p. 4407), is amended by striking Section 1 thereof.

                         SECTION 2.

  1-14  Said Act is further amended by striking Section 2 thereof,
  1-15  which reads as follows:

                        "SECTION 2.

  1-16    One member of the Hospital Authority shall be a member of
  1-17    the Board of Commissioners of Floyd County.  Such member
  1-18    shall be selected by the Board of Commissioners from its
  1-19    own membership.  The member so selected shall remain a
  1-20    member of the Hospital Authority during his term of office
  1-21    as a Commissioner.  Successors to such member shall
  1-22    likewise be selected by the Board of Commissioners from
  1-23    its own membership, and any vacancy occurring in the
  1-24    office of such member shall be filled by the Board of
  1-25    Commissioners in the same manner.  In the event any such
  1-26    member ceases to be a member of the Board of Commissioners
  1-27    for any reason, he shall also cease to be a member of the
  1-28    Hospital Authority, and the vacancy thus created shall be
  1-29    filled as herein provided.",

  1-30  and inserting in its place the following:

                        "SECTION 2.

  2- 1    (a) The members of the Hospital Authority of Floyd County
  2- 2    who are serving as such upon the date this Act becomes
  2- 3    effective in 1996 shall serve out their terms of office
  2- 4    and until their successors are appointed and qualified
  2- 5    pursuant to the provisions of this section.  That member
  2- 6    of the authority who is a member of the Board of
  2- 7    Commissioners of Floyd County and appointed by such board
  2- 8    shall serve until such member's term of office as a member
  2- 9    of that board of commissioners next expires and until the
  2-10    appointment and qualification of a successor.

  2-11    (b) The successors to the members of the authority whose
  2-12    terms of office expire on or after the 1996 effective date
  2-13    of this section and all future successors to members whose
  2-14    terms of office expire shall be nominated by the Board of
  2-15    Commissioners of Floyd County and selected by the grand
  2-16    jury of Floyd County.  That board shall submit a list of
  2-17    three eligible persons to the grand jury of Floyd County.
  2-18    Such list shall be furnished to the foreman of the grand
  2-19    jury of Floyd County, and that grand jury shall either
  2-20    select by majority vote one of the persons named in such
  2-21    list or decline to select any of the persons named in the
  2-22    list.  Should the grand jury decline to select any of the
  2-23    persons named in the list, the foreman of the grand jury
  2-24    shall so notify the board of commissioners.  Such board
  2-25    shall then submit a new list of three eligible persons,
  2-26    none of whom was named on the earlier list, to the grand
  2-27    jury.  The grand jury shall select one of the persons
  2-28    named in such list or decline to select any of the persons
  2-29    named in the list.  This process shall be repeated until
  2-30    one of the persons named in the list is selected.  Nothing
  2-31    in this section shall prohibit a member of the Board of
  2-32    Commissioners of Floyd County from being selected as a
  2-33    member of the Hospital Authority of Floyd County.

  2-34    (c) If a vacancy occurs in the office of any member of the
  2-35    authority other than by expiration of term, that vacancy
  2-36    shall be filled as provided in subsection (b) of this
  2-37    section.  The duration of the terms of office of members
  2-38    of the hospital authority shall not be changed by this
  2-39    section."

                         SECTION 3.

  2-40  This Act shall become effective upon its approval by the
  2-41  Governor or upon its becoming law without such approval.

  3- 1  All laws and parts of laws in conflict with this Act are
  3- 2  repealed.
