HB 1709 LC 21 3907 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 43-14-8 of the Official Code of 1- 2 Georgia Annotated, relating to licenses required of 1- 3 electrical, plumbing, and conditioned air contractors, so as 1- 4 to provide a period for applying for an unrestricted license 1- 5 by certain persons; to repeal conflicting laws; and for 1- 6 other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Code Section 43-14-8 of the Official Code of Georgia 1- 9 Annotated, relating to licenses required of electrical, 1-10 plumbing, and conditioned air contractors, is amended by 1-11 striking in its entirety subsection (d) and inserting in 1-12 lieu thereof the following: 1-13 "(d)(1) Notwithstanding any other provision of this 1-14 chapter, prior to and including September 30, 1983, the 1-15 following persons, desiring to qualify under the 1-16 provisions stated in this subsection, shall be issued a 1-17 state-wide license without restriction by the 1-18 appropriate division of the State Construction Industry 1-19 Licensing Board, provided that such individual submits 1-20 proper application and pays or has paid the required 1-21 fees and is not otherwise in violation of this chapter: 1-22 (1)(A) Any individual holding a license issued by the 1-23 State Construction Industry Licensing Board, prior to 1-24 the effective date of this chapter; 1-25 (2)(B) Any individual holding a license issued by the 1-26 State Board of Electrical Contractors, the State Board 1-27 of Examiners of Plumbing Contractors, or the State 1-28 Board of Warm Air Heating Contractors; 1-29 (3)(C) Any individual holding a license to engage in 1-30 such vocation issued to him or her by any governing 1-31 authority of any political subdivision; and -1- (Index) LC 21 3907 2- 1 (4)(D) Any individual who has successfully and 2- 2 efficiently engaged in such vocation in a local 2- 3 jurisdiction, which did not issue local licenses, for 2- 4 a period of at least two consecutive years immediately 2- 5 prior to the time of application. To prove that he or 2- 6 she has successfully engaged in said vocation, the 2- 7 individual shall only be required to give evidence of 2- 8 three successful jobs completed over such period. 2- 9 Such applicant shall swear before a notary public that 2-10 such evidence is true and accurate prior to its 2-11 submission to the division." 2-12 (2) Any person who was qualified to receive a license on 2-13 or before September 30, 1983, as provided in paragraph 2-14 (1) of this subsection and who failed to do so but who 2-15 from that date has been continuously employed by a 2-16 business or corporation in a position requiring skill 2-17 and knowledge in the maintenance and repair of 2-18 conditioned air equipment, notwithstanding any absence 2-19 from work caused by a job related injury, shall be 2-20 entitled to receive such a license by complying with the 2-21 requirements of paragraph (1) of this subsection prior 2-22 to September 30, 1996." SECTION 2. 2-23 All laws and parts of laws in conflict with this Act are 2-24 repealed. -2- (Index)
