HB 1769 LC 18 7490 A BILL TO BE ENTITLED AN ACT 1- 1 To repeal an Act approved March 20, 1985 (Ga. L. 1985, p. 1- 2 3888), which continued in force and effect as part of the 1- 3 Constitution of the State of Georgia that constitutional 1- 4 amendment duly ratified at the 1972 general election (Res. 1- 5 Act No. 218; H.R. 733-1686; Ga. L. 1972, p. 1452) and 1- 6 proclaimed by the Governor to be a part of the Constitution 1- 7 of the State of Georgia relating to the election of the 1- 8 Board of Tax Assessors of Lowndes County; to repeal that 1- 9 constitutional amendment duly ratified at the 1972 general 1-10 election (Res. Act No. 218; H.R. 733-1686; Ga. L. 1972, p. 1-11 1452) and proclaimed by the Governor to be a part of the 1-12 Constitution of the State of Georgia relating to the 1-13 election of the Board of Tax Assessors of Lowndes County; to 1-14 provide for the appointment of the members of the board of 1-15 tax assessors of Lowndes County; to provide that all matters 1-16 relating to the board shall be pursuant to the general laws 1-17 of the State of Georgia; to provide for the transfer of 1-18 books, documents, records, property, powers, duties, 1-19 actions, appeals, and other matters; to provide that no 1-20 elections for membership on such board shall be conducted in 1-21 2000 or thereafter; to provide the authority for this Act; 1-22 to provide for a referendum; to provide effective dates; to 1-23 repeal conflicting laws; and for other purposes. 1-24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-25 That Act approved March 20, 1985 (Ga. L. 1985, p. 3888), 1-26 which continued in force and effect as part of the 1-27 Constitution of the State of Georgia that constitutional 1-28 amendment duly ratified at the 1972 general election (Res. 1-29 Act No. 218; H.R. 733-1686; Ga. L. 1972, p. 1452) and 1-30 proclaimed by the Governor to be a part of the Constitution 1-31 of the State of Georgia, relating to the election of the 1-32 Board of Tax Assessors of Lowndes County, is repealed in its 1-33 entirety effective December 31, 2000. Lowndes County; board of tax assessors 1769 -1- (Index) LC 18 7490 SECTION 2. 2- 1 That constitutional amendment duly ratified at the 1972 2- 2 general election (Res. Act No. 218; H.R. 733-1686; Ga. L. 2- 3 1972, p. 1452) and proclaimed by the Governor to be a part 2- 4 of the Constitution of the State of Georgia, relating to the 2- 5 election of the Board of Tax Assessors of Lowndes County and 2- 6 which was continued on and after July 1, 1987, as a part of 2- 7 the Constitution of the State of Georgia, is repealed in its 2- 8 entirety effective December 31, 2000. SECTION 3. 2- 9 (a) Prior to December 31, 2000, it shall be the duty of the 2-10 governing authority of Lowndes County to appoint members of 2-11 a board of tax assessors. Such board shall be appointed and 2-12 the members thereof shall have such qualifications, terms, 2-13 duties, and powers as provided by the general laws of the 2-14 State of Georgia. Terms of office of such members shall 2-15 begin on January 1, 2001. On January 1, 2001, the powers, 2-16 duties, books, documents, and property of the former elected 2-17 board of tax assessors and all pending actions, matters, and 2-18 appeals of or before such former board shall be transferred 2-19 to the newly appointed board. Any such action, matter, or 2-20 appeal shall not be affected or abated by the change in the 2-21 manner of selecting members of the board of tax assessors 2-22 and the transfers authorized by this section. 2-23 (b) No election for membership on the Board of Tax Assessors 2-24 of Lowndes County shall be held or conducted in 2000 or 2-25 thereafter. SECTION 4. 2-26 This Act is passed pursuant to Article XI, Section I, 2-27 Paragraph IV(b) of the Constitution of the State of Georgia 2-28 which authorizes the repeal of certain amendments to the 2-29 Constitution which were continued in force and effect after 2-30 July 1, 1987. SECTION 5. 2-31 Unless prohibited by the federal Voting Rights Act of 1965, 2-32 as amended, the election superintendent of Lowndes County 2-33 shall call and conduct an election as provided in this 2-34 section for the purpose of submitting this Act to the 2-35 electors of Lowndes County for approval or rejection. The 2-36 election superintendent shall conduct that election on the 2-37 date of the November, 1996, general election and shall issue 2-38 the call and conduct that election as provided by general -2- (Index) LC 18 7490 3- 1 law. The superintendent shall cause the date and purpose of 3- 2 the election to be published once a week for two weeks 3- 3 immediately preceding the date thereof in the official organ 3- 4 of Lowndes County. The ballot shall have written or printed 3- 5 thereon the words: 3- 6 "( ) YES Shall the local constitutional amendment be 3- 7 repealed which provides for the election of 3- 8 ( ) NO the Board of Tax Assessors of Lowndes County 3- 9 so that the members of the board shall be 3-10 appointed as provided by general law on and 3-11 after January 1, 2001?" 3-12 All persons desiring to vote for approval of the Act shall 3-13 vote "Yes," and those persons desiring to vote for rejection 3-14 of the Act shall vote "No." If more than one-half of the 3-15 votes cast on such question are for approval of the Act, 3-16 Sections 1, 2, and 3 of this Act shall become of full force 3-17 and effect immediately. If Sections 1, 2, and 3 of this Act 3-18 are not so approved or if the election is not conducted as 3-19 provided in this section, this Act shall be automatically 3-20 repealed on the first day of January immediately following 3-21 that election date. 3-22 The expense of such election shall be borne by Lowndes 3-23 County. It shall be the election superintendent's duty to 3-24 certify the result thereof to the Secretary of State. SECTION 6. 3-25 Except as otherwise provided in Section 5 of this Act, this 3-26 Act shall become effective upon its approval by the Governor 3-27 or upon its becoming law without such approval. SECTION 7. 3-28 All laws and parts of laws in conflict with this Act are 3-29 repealed. -3- (Index)
