A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 1 of Chapter 7 of Title 24 of the Official
1- 2 Code of Georgia Annotated, relating to authentication of
1- 3 writings in general, so as to provide for the authenticity
1- 4 of medical reports; to provide for admissibility of such
1- 5 medical reports; to provide for related matters; to repeal
1- 6 conflicting laws; and for other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 8 Article 1 of Chapter 7 of Title 24 of the Official Code of
1- 9 Georgia Annotated, relating to authentication of writings in
1-10 general, is amended by adding a new Code section at the end
1-11 thereof to read as follows:
1-12 "24-7-10. (Index)
1-13 Upon the trial of any civil case involving injury or
1-14 disease, any medical report in narrative form provided to
1-15 the adverse party 60 days prior to trial or consented to
1-16 by the parties, which is signed and dated by a treating
1-17 licensed, practicing medical doctor, doctor of
1-18 chiropractic, dentist, orthodontist, podiatrist,
1-19 psychologist, marriage and family therapist, social
1-20 worker, or professional counselor shall be admissible in
1-21 evidence insofar as it purports to represent the history,
1-22 examination, diagnosis, treatment, and prognosis of the
1-23 person signing the report, as if that person were present
1-24 at the hearing and testifying as a witness, subject to the
1-25 right of any party to object to the admissibility of any
1-26 portion of the report and subject to the right of an
1-27 adverse party to cross-examine the person signing the
1-28 report and provide a rebuttal testimony. The party
1-29 tendering the medical report may also introduce the
1-30 testimony of the person who signed the medical report for
1-31 the purpose of supplementing the report."
