HB 179 LC 10 0980 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 1 of Chapter 4 of Title 38 of the Official 1- 2 Code of Georgia Annotated, relating to the Department of 1- 3 Veterans Service, so as to provide that no person shall be 1- 4 appointed to or employed in the position of a veterans 1- 5 service field office manager unless such person has served 1- 6 in the armed services of the United States during a war or 1- 7 conflict in which the United States was engaged; to repeal 1- 8 conflicting laws; and for other purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Article 1 of Chapter 4 of Title 38 of the Official Code of 1-11 Georgia Annotated, relating to the Department of Veterans 1-12 Service, is amended by striking in its entirety Code Section 1-13 38-4-9, relating to the employment of personnel within the 1-14 Department of Veterans Service, and inserting in lieu 1-15 thereof a new Code Section 38-4-9 to read as follows: 1-16 "38-4-9. (Index) 1-17 (a) The commissioner of veterans service is authorized and 1-18 directed to employ competent personnel to assist in the 1-19 administration of the Department of Veterans Service. The 1-20 commissioner shall give reasonable preference to veterans, 1-21 their surviving spouses, and dependents in the matter of 1-22 employment in the department; provided, however, that 1-23 competency and efficiency shall not be sacrificed because 1-24 of veteran affiliation, relationship, or service. It shall 1-25 be the duty of the commissioner to advise the Governor, 1-26 the Veterans Service Board, and the General Assembly as to 1-27 needed veterans' legislation. As executive officer, the 1-28 commissioner shall have exclusive authority to employ 1-29 personnel necessary to carry out the purposes of this 1-30 article and shall define the duties of employees, assign 1-31 their official stations, and fix their compensation 1-32 subject to the state merit system. -1- (Index) LC 10 0980 2- 1 (b) No person shall be appointed to or employed in the 2- 2 position of a veterans service field office manager unless 2- 3 such person has served in the armed services of the United 2- 4 States during a war or conflict in which the United States 2- 5 was engaged."
