HB 182 HB 182/AP H. B. No. 182 (AS PASSED HOUSE AND SENATE) By: Representatives Mueller of the 152nd, Randall of the 127th, Smith of the 174th, Bostick of the 165th, Hembree of the 98th and others A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 9-13-140 of the Official Code of 1- 2 Georgia Annotated, relating to advertisement of judicial 1- 3 sales, so as to require that the street address of real 1- 4 property be included in such advertisement; to provide an 1- 5 effective date; to repeal conflicting laws; and for other 1- 6 purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Code Section 9-13-140 of the Official Code of Georgia 1- 9 Annotated, relating to advertisement of judicial sales, is 1-10 amended by striking subsection (a) and inserting in its 1-11 place a new subsection (a) to read as follows: 1-12 "(a) The sheriff, coroner, or other officer shall publish 1-13 weekly for four weeks in some newspaper published at the 1-14 county site, and if there is no newspaper published at the 1-15 county site, then in any paper published in the county, or 1-16 if there is no such paper published in the county, then in 1-17 the nearest newspaper having the largest general 1-18 circulation in such county, notice of all sales of land 1-19 and other property executed by him the officer. In the 1-20 advertisement he the officer shall give a full and 1-21 complete description of the property to be sold, making 1-22 known the names of the plaintiff, the defendant, and any 1-23 person who may be in the possession of the property. In 1-24 addition, in the case of real property, such advertisement 1-25 shall include the street address of such real property." SECTION 2. 1-26 This Act shall become effective July 1, 1996. SECTION 3. 1-27 All laws and parts of laws in conflict with this Act are 1-28 repealed. H. B. No. 182 -1- (Index)
