A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 2 of Chapter 2 of Title 46 of the Official
1- 2 Code of Georgia Annotated, relating to the jurisdiction,
1- 3 powers, and duties of the Public Service Commission, so as
1- 4 to prohibit rate schedules authorizing long-distance
1- 5 telephone charges for calls between two telephones having
1- 6 the same three-digit local exchange; to provide for
1- 7 amendment of existing rate schedules to comply with such
1- 8 prohibition; to provide for modification of rate schedules
1- 9 in the discretion of the commission; to provide that this
1-10 Act shall not be interpreted as amending, modifying, or
1-11 repealing a specified Code section relating to the
1-12 commission's rate-making power; to repeal conflicting laws;
1-13 and for other purposes.
1-14 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-15 Article 2 of Chapter 2 of Title 46 of the Official Code of
1-16 Georgia Annotated, relating to the jurisdiction, powers, and
1-17 duties of the Public Service Commission, is amended by
1-18 inserting a new Code section to be designated Code Section
1-19 46-2-25.3 to read as follows:
1-20 "46-5-25.3. (Index)
1-21 (a) Except as provided by subsection (b) of this Code
1-22 section, on and after July 1, 1996, the commission shall
1-23 not approve any rate schedule which authorizes a
1-24 long-distance charge for calls between two telephones
1-25 having the same three-digit local exchange. Where two or
1-26 more telephone companies operate the same three-digit
1-27 local exchange, each company shall provide local calling
1-28 to other telephones in the same three-digit local exchange
1-29 within the area served by the other company or companies.
1-30 Rate schedules approved prior to July 1, 1996, shall be
1-31 amended to comply with this Code section by not later than
1-32 July 1, 1997.

2- 1 (b) All rate schedules approved pursuant to this Code
2- 2 section may be modified at the discretion of the
2- 3 commission upon a good and sufficient showing of
2- 4 geographic, economic, or technological infeasibility by a
2- 5 telephone company.
2- 6 (c) Nothing in this Code section shall be interpreted as
2- 7 amending, modifying, or repealing Code Section 46-2-23,
2- 8 relating to the rate-making power of the commission
2- 9 generally and special provisions concerning
2-10 telecommunications companies."
SECTION 2.
2-11 All laws and parts of laws in conflict with this Act are
2-12 repealed.
