A BILL TO BE ENTITLED
AN ACT
1- 1 To provide for an advisory referendum election to be held in
1- 2 the Bartow County School District for the purpose of
1- 3 determining whether each of the five members of the Bartow
1- 4 County Board of Education should reside in a single-member
1- 5 education district and be elected by the voters residing
1- 6 only in that education district or should reside in a
1- 7 single-member education district and be elected by the
1- 8 voters of the entire Bartow County School District; to
1- 9 provide for legislative findings and declarations; to
1-10 provide for procedures and requirements; to provide for
1-11 other matters relative to the foregoing; to repeal
1-12 conflicting laws; and for other purposes.
1-13 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-14 It is the purpose of this Act to provide for an advisory
1-15 referendum election to be held in the Bartow County School
1-16 District for the purpose of ascertaining whether the
1-17 electors of such school district are in favor of each of the
1-18 five members of the Bartow County Board of Education being
1-19 required to reside in a single-member education district and
1-20 be elected by the voters residing only in that education
1-21 district or being required to reside in a single-member
1-22 education district and be elected by the voters of the
1-23 entire Bartow County School District.
SECTION 2.
1-24 (a) Unless prohibited by the federal Voting Rights Act of
1-25 1965, as amended, the election superintendent of Bartow
1-26 County shall call and conduct an advisory referendum
1-27 election as provided in this section for the purpose of
1-28 submitting one question to the electors of the Bartow County
1-29 School District to determine whether the electors of such
1-30 school district are in favor of each of the five members of
1-31 the Bartow County Board of Education: (1) being required to
1-32 reside in a single-member education district and be elected

2- 1 by the voters residing only in that education district, or
2- 2 (2) being required to reside in a single-member education
2- 3 district and be elected by the voters of the entire Bartow
2- 4 County School District. The superintendent shall set the
2- 5 date of such election for the Tuesday after the first Monday
2- 6 in November, 1996, and shall issue the call therefor not
2- 7 less than 30 nor more than 60 days prior to that date. The
2- 8 superintendent shall cause the date and purpose of the
2- 9 election to be published once a week for two weeks
2-10 immediately preceding the date thereof in the official organ
2-11 of Bartow County. The ballot shall have written or printed
2-12 thereon the following:
2-13 "Advisory Referendum Election
2-14 Select the manner of electing members of the Board of
2-15 Education of Bartow County which you prefer by placing a
2-16 check (/) mark or (X) in the appropriate space below.
2-17 Vote for only one of the options below.
2-18 If the Bartow County School District is divided into five
2-19 education districts with one member of the board of
2-20 education residing in each education district, do you
2-21 want:
2-22 _________ (1) The member of the board of education
2-23 residing in each education district to be elected by the
2-24 voters residing only within that education district; or
2-25 _________ (2) Each member of the board of education to
2-26 be elected by the voters of the entire Bartow County
2-27 School District?"
2-28 (b) It shall be the duty of the election superintendent of
2-29 Bartow County to hold and conduct the advisory election
2-30 provided for in this section and to tabulate the results of
2-31 such election. It shall be the further duty of said
2-32 superintendent to certify the results of said election to
2-33 the Secretary of State and to each member of the General
2-34 Assembly whose Senatorial or Representative District lies
2-35 wholly or partially within Bartow County. The expense of
2-36 such election shall be borne by Bartow County.
2-37 (c) It is found, determined, and declared that the holding
2-38 of the advisory referendum election provided for in this
2-39 section is in all respects for the benefit of the people of
2-40 Bartow County and the Bartow County School District, is for
2-41 a public purpose, and is an essential governmental function
2-42 for which public funds may be expended.

SECTION 3.
3- 1 All laws and parts of laws in conflict with this Act are
3- 2 repealed.
