                        A BILL TO BE ENTITLED
                               AN ACT


  1- 1  To amend Article 3 of Chapter 2 of Title 40 of the Official
  1- 2  Code of Georgia Annotated, relating to prestige license
  1- 3  plates and special plates for certain persons and vehicles,
  1- 4  so as to provide for creation of a special and distinctive
  1- 5  wildflower license plate; to provide for fees; to provide
  1- 6  for dedication of such fees to the Georgia Wildflower
  1- 7  Project Trust Fund; to provide for authority of the
  1- 8  commissioner; to provide for related matters; to repeal
  1- 9  conflicting laws; and for other purposes.

  1-10        BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA

                         SECTION 1.

  1-11  Article 3 of Chapter 2 of Title 40 of the Official Code of
  1-12  Georgia Annotated, relating to prestige license plates and
  1-13  special plates for certain persons and vehicles, is amended
  1-14  by inserting a new Code Section 40-2-60.1 to read as
  1-15  follows:

  1-16    "40-2-60.1. (Index)

  1-17    (a) The commissioner shall prepare special and distinctive
  1-18    license plates of a design appropriate to commemorate
  1-19    wildflowers native to or commonly found in the State of
  1-20    Georgia.  Any motor vehicle owner who is a resident of
  1-21    Georgia, upon complying with the motor vehicle laws
  1-22    relating to registration and licensing of motor vehicles
  1-23    and, except as provided in subsection (c) of this Code
  1-24    section, upon the payment of a fee of $25.00 in addition
  1-25    to the regular motor vehicle registration fee, shall be
  1-26    issued such a special license plate by the commissioner.
  1-27    Special wildflower license plates issued pursuant to this
  1-28    Code section shall be subject to an additional annual
  1-29    registration fee of $25.00 as a condition of obtaining an
  1-30    annual revalidation decal for such license plate which fee
  1-31    shall be collected by the county tag agent at the time of
  1-32    collection of other registration fees and shall be
  1-33    remitted to the state as provided in Code Section 40-2-34.

  2- 1    (b) All manufacturing fees and any additional annual fees
  2- 2    received by the department for such special wildflower
  2- 3    license plates shall be dedicated to the Georgia
  2- 4    Wildflower Project Trust Fund as created by Article III,
  2- 5    Section IX, Paragraph VI of the Georgia Constitution.

  2- 6    (c) The commissioner is authorized to establish procedures
  2- 7    and promulgate rules and regulations for carrying out this
  2- 8    Code section."

                         SECTION 2.

  2- 9  All laws and parts of laws in conflict with this Act are
  2-10  repealed.
