HB 227 LC 9 8020 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 40-6-315 of the Official Code of 1- 2 Georgia Annotated, relating to headgear and eye-protective 1- 3 devices for motorcycle riders, so as to change the 1- 4 requirement of wearing of headgear so that it will only 1- 5 apply to certain persons; to repeal conflicting laws; and 1- 6 for other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Code Section 40-6-315 of the Official Code of Georgia 1- 9 Annotated, relating to headgear and eye-protective devices 1-10 for motorcycle riders, is amended by striking subsection (a) 1-11 in its entirety and inserting in lieu thereof a new 1-12 subsection (a) to read as follows: 1-13 "(a) (1) No person under the age of 21 shall operate or 1-14 ride upon a motorcycle unless he such person is wearing 1-15 protective headgear which complies with standards 1-16 established by the Board of Public Safety. 1-17 (2)(A) Any person 21 years of age or older operating a 1-18 motorcycle without wearing protective headgear which 1-19 complies with standards established by the Board of 1-20 Public Safety must be able to furnish, upon request of 1-21 a law enforcement officer, proof of completion of a 1-22 motorcycle rider education course approved by the 1-23 Board of Public Safety. 1-24 (B) No person 21 years of age or older shall be 1-25 authorized to ride as a passenger upon a motorcycle 1-26 without wearing protective headgear which complies 1-27 with standards established by the Board of Public 1-28 Safety unless the operator of the motorcycle is able 1-29 to furnish, upon request of a law enforcement officer, 1-30 proof of completion of a motorcycle rider education 1-31 course approved by the Board of Public Safety. -1- (Index) LC 9 8020 2- 1 (C) Any person 21 years of age or older who has not 2- 2 successfully completed a motorcycle rider education 2- 3 course approved by the Board of Public Safety shall be 2- 4 required to wear protective headgear which complies 2- 5 with standards established by the Board of Public 2- 6 Safety when operating a motorcycle." SECTION 2. 2- 7 All laws and parts of laws in conflict with this Act are 2- 8 repealed. -2- (Index)
