A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 40-5-2 of the Official Code of Georgia
1- 2 Annotated, relating to maintenance of driver's license
1- 3 records and driver records by the Department of Public
1- 4 Safety, so as to provide that the records of convictions
1- 5 therein shall include only those convictions for which the
1- 6 assessment of points on the driving record is required; to
1- 7 provide for related matters; to repeal conflicting laws; and
1- 8 for other purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-10 Code Section 40-5-2 of the Official Code of Georgia
1-11 Annotated, relating to maintenance of driver's license
1-12 records and driver records by the Department of Public
1-13 Safety, is amended by striking subsection (c) and inserting
1-14 in its place a new subsection to read as follows:
1-15 "(c) The department shall also file all accident reports
1-16 and abstracts of court records of convictions requiring
1-17 the assessment of points on the driving record that are
1-18 received by it under the laws of this state and in
1-19 connection therewith maintain convenient records or make
1-20 suitable notations in order that an individual record of
1-21 each licensee showing the convictions of such licensee and
1-22 the traffic accidents in which he has been involved shall
1-23 be readily ascertainable and available for the
1-24 consideration of the department upon any application for
1-25 renewal of license and at other suitable times. For
1-26 purposes of issuing a driver's operating record to the
1-27 public as provided in paragraphs (1) and (2) of subsection
1-28 (d) of this Code section, the period of calculation for
1-29 compilation of such report shall be determined by the date
1-30 of arrest."
SECTION 2.
1-31 All laws and parts of laws in conflict with this Act are
1-32 repealed.
