HB 311 LC 16 3806 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 5 of Chapter 3 of Title 47 of the Official 1- 2 Code of Georgia Annotated, relating to service creditable 1- 3 toward retirement benefits under the Teachers Retirement 1- 4 System of Georgia, so as to authorize creditable service for 1- 5 unused sick leave which is accumulated at the time of 1- 6 retirement; to provide for other matters relative to the 1- 7 foregoing; to provide conditions for an effective date and 1- 8 for automatic repeal; to repeal conflicting laws; and for 1- 9 other purposes. 1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-11 Article 5 of Chapter 3 of Title 47 of the Official Code of 1-12 Georgia Annotated, relating to service creditable toward 1-13 retirement benefits under the Teachers Retirement System of 1-14 Georgia, is amended by adding at the end thereof a new Code 1-15 Section 47-3-92 to read as follows: 1-16 "47-3-92. (Index) 1-17 (a) A member shall receive creditable service under the 1-18 retirement system for any unused sick leave. The member 1-19 shall receive one month of creditable service for each 20 1-20 days of unused sick leave. No creditable service shall be 1-21 given for less than 20 days of unused sick leave. 1-22 Creditable service for accumulated unused sick leave shall 1-23 be given to a member only at the time of retirement. 1-24 (b) Each employer shall maintain sick leave records for 1-25 members of the retirement system who are eligible to 1-26 receive creditable service for unused sick leave and shall 1-27 furnish the board of trustees with such records and 1-28 certifications as the board, by rule or regulation, may 1-29 require to carry out the provisions of this Code section. 1-30 The board may require such documentation as may be 1-31 necessary to verify unused sick leave which is claimed for 1-32 creditable service. Teachers Retirement; creditable service; unused sick leave 311a -1- (Index) LC 16 3806 2- 1 (c) Any unused sick leave for which any member receives 2- 2 compensation pursuant to the provisions of Code Section 2- 3 20-2-853, or pursuant to the provisions of any other 2- 4 Georgia law, statute, rule, or regulation of any 2- 5 governmental entity, shall be forfeited and no creditable 2- 6 service may be obtained under this Code section for such 2- 7 forfeited sick leave. 2- 8 (d) As a condition for any member receiving creditable 2- 9 service under this Code section, the board of trustees 2-10 shall require such documentation as may be necessary to 2-11 prove that compensation has not been received for unused 2-12 sick leave claimed as creditable service." SECTION 2. 2-13 This Act shall become effective on July 1, 1996, only if it 2-14 is determined to have been concurrently funded as provided 2-15 in Chapter 20 of Title 47 of the Official Code of Georgia 2-16 Annotated, the "Public Retirement Systems Standards Law"; 2-17 otherwise, this Act shall not become effective and shall be 2-18 automatically repealed in its entirety on July 1, 1996, as 2-19 required by subsection (a) of Code Section 47-20-50.
