HB 386 LC 9 7935 A BILL TO BE ENTITLED AN ACT 1- 1 To amend an Act which repealed the charter of the City of 1- 2 Omaha and abolished the city, approved March 24, 1994 (Ga. 1- 3 L. 1994, p. 3815), so as to provide for the disposition of 1- 4 the assets and liabilities, causes of action, accounts, and 1- 5 real and personal property of the City of Omaha; to provide 1- 6 for the transfer of all such assets, liabilities, causes of 1- 7 action, accounts, and real and personal property to the 1- 8 governing authority of Stewart County and for the assumption 1- 9 thereof by Stewart County; to provide for the payment of the 1-10 debts of the city; to provide for other matters relative to 1-11 the foregoing; to repeal conflicting laws; and for other 1-12 purposes. 1-13 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-14 An Act which repealed the charter of the City of Omaha and 1-15 abolished the city, approved March 24, 1994 (Ga. L. 1994, p. 1-16 3815), is amended by adding, following Section 1, a new 1-17 Section 1.1 to read as follows: 1-18 "SECTION 1.1. 1-19 All of the assets and liabilities, causes of action, 1-20 accounts, contracts, and real and personal property of the 1-21 City of Omaha in existence on the date of the abolition of 1-22 the city under this Act are transfered to the governing 1-23 authority of Stewart County. Any unencumbered assets of 1-24 such city shall first be used by the governing authority 1-25 of the county to pay any debts and fulfill any contracts 1-26 of the city in existence on the date of abolition of the 1-27 city or arising thereafter. Any remaining assets or 1-28 property shall be and become the property of Stewart 1-29 County to be retained, used, and disposed of as directed 1-30 by the governing authority of such county." -1- (Index) LC 9 7935 SECTION 2. 2- 1 All laws and parts of laws in conflict with this Act are 2- 2 repealed. -2- (Index)
