HB 439 LC 24 0045 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Part 1 of Article 2 of Chapter 8 of Title 12 of the 1- 2 Official Code of Georgia Annotated, relating to general 1- 3 provisions of solid waste management, so as to require city 1- 4 and county permits for the disposal of tires; to provide for 1- 5 related matters; to repeal conflicting laws; and for other 1- 6 purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Part 1 of Article 2 of Chapter 8 of Title 12 of the Official 1- 9 Code of Georgia Annotated, relating to general provisions of 1-10 solid waste management, is amended by striking subsection 1-11 (a) of Code Section 12-8-24, relating to permits for solid 1-12 waste disposal and handling, and inserting in lieu thereof a 1-13 new subsection (a) to read as follows: 1-14 "(a)(1) No person shall engage in solid waste or special 1-15 solid waste handling in Georgia or construct or operate 1-16 a solid waste handling facility in Georgia, except those 1-17 individuals exempted from this part under Code Section 1-18 12-8-30.10, without first obtaining a permit from the 1-19 director authorizing such activity. 1-20 (2) No person shall engage in the disposal of tires or 1-21 scrap tires without first obtaining a permit from the 1-22 city or county in which the tires or scrap tires are to 1-23 be disposed, except those individuals exempted from this 1-24 part by Code Section 12-8-30.10. The permit shall state 1-25 the location or locations where the tires or scrap tires 1-26 will be disposed. To obtain a city or county permit, a 1-27 person must show to the permit-issuing authority the 1-28 permit required by paragraph (1) of subsection (a) of 1-29 this Code section. The city or county permit must be 1-30 shown whenever a person takes or receives tires or scrap 1-31 tires for disposal and whenever requested by a city or 1-32 county law enforcement official." -1- (Index) LC 24 0045 SECTION 2. 2- 1 Said part is further amended by striking subsection (a) of 2- 2 Code Section 12-8-40.1, relating to tire disposal 2- 3 restrictions, and inserting in lieu thereof a new subsection 2- 4 (a) to read as follows: 2- 5 "(a) Effective July 1, 1990 1995, each city and county 2- 6 shall require a permit as specified in paragraph (2) of 2- 7 subsection (a) of Code Section 12-8-24. Effective July 1, 2- 8 1990, each city, county, or solid waste management 2- 9 authority shall have the right to impose certain 2-10 restrictions on scrap tires originating in or which may 2-11 ultimately be disposed of in its area of jurisdiction. 2-12 These restrictions may include but are not limited to: 2-13 (1) A ban on the disposal of scrap tires at solid waste 2-14 disposal facilities within its control; and 2-15 (2) A requirement that scrap tires be recycled, 2-16 shredded, chopped, or otherwise processed in an 2-17 environmentally sound manner prior to disposal at solid 2-18 waste disposal facilities owned or operated by the city, 2-19 county, or authority." SECTION 3. 2-20 All laws and parts of laws in conflict with this Act are 2-21 repealed. -2- (Index)
