A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Chapter 2 of Title 47 of the Official Code of
1- 2 Georgia Annotated, relating to the Employees' Retirement
1- 3 System of Georgia, so as to provide that members with prior
1- 4 service as a narcotics agent with the Georgia Bureau of
1- 5 Investigation shall be eligible to obtain creditable service
1- 6 for such prior service; to provide conditions for an
1- 7 effective date and automatic repeal; to repeal conflicting
1- 8 laws; and for other purposes.
1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-10 Chapter 2 of Title 47 of the Official Code of Georgia
1-11 Annotated, relating to the Employees' Retirement System of
1-12 Georgia, is amended by inserting at the end of Part 5 of
1-13 Article 8, relating to membership of certain law enforcement
1-14 personnel in such retirement system, the following:
1-15 "47-2-225. (Index)
1-16 Any other provision of this chapter to the contrary
1-17 notwithstanding, any member who was employed as a
1-18 narcotics agent pursuant to the provisions of Code Section
1-19 35-3-9 prior to becoming a member of the retirement system
1-20 shall be entitled to obtain creditable service for all
1-21 such prior service subject to the conditions contained in
1-22 this Code section. In order to be eligible for such
1-23 creditable service, the member must make application as
1-24 prescribed by the board not later than July 1, 1997, or
1-25 one year after becoming a member of the retirement system,
1-26 whichever date is later, provide proof of such prior
1-27 service, and pay the employee contributions which he or
1-28 she would have paid if he or she had been a member of the
1-29 retirement system, together with regular interest thereon.
1-30 Within 30 days after the retirement system gives notice
1-31 that the foregoing conditions have been met, the Georgia
1-32 Bureau of Investigation shall pay the employer
1-33 contributions which would have been paid for the member if

2- 1 he or she had been a member of the retirement system,
2- 2 together with regular interest thereon."
SECTION 2.
2- 3 Said chapter is further amended by striking in its entirety
2- 4 paragraph (2) of subsection (f) of Code Section 47-2-334,
2- 5 relating to membership in such retirement system by certain
2- 6 employees employed on or after July 1, 1982, and inserting
2- 7 in lieu thereof the following:
2- 8 "(2) Except as otherwise provided in Code Sections
2- 9 47-2-204, 47-2-225, and 47-2-266 and paragraph (3) of
2-10 this subsection, no service shall constitute creditable
2-11 service except membership service for which the full
2-12 rate of employee membership contributions and employer
2-13 contributions is made pursuant to subsections (c) and
2-14 (d) of this Code section; and"
SECTION 3.
2-15 This Act shall become effective on July 1, 1996, only if it
2-16 is determined to have been concurrently funded as provided
2-17 in Chapter 20 of Title 47 of the Official Code of Georgia
2-18 Annotated, the "Public Retirement Systems Standards Law";
2-19 otherwise, this Act shall not become effective and shall be
2-20 automatically repealed in its entirety on July 1, 1996, as
2-21 required by subsection (a) of Code Section 47-20-50.
SECTION 4.
2-22 All laws and parts of laws in conflict with this Act are
2-23 repealed.
