HB 45 LC 22 1342 A BILL TO BE ENTITLED AN ACT 1- 1 To provide for an additional judge of the superior court of 1- 2 the Cobb Judicial Circuit; to provide for the initial 1- 3 appointment and subsequent election of such judge and of 1- 4 such judge's successors; to provide for terms; to prescribe 1- 5 the powers of said judge; to prescribe the compensation and 1- 6 allowances of said judge; to amend Code Section 15-6-2 of 1- 7 the Official Code of Georgia Annotated, relating to the 1- 8 number of superior court judges for each of the judicial 1- 9 circuits, so as to provide for an additional judge of the 1-10 superior court of the Cobb Judicial Circuit; to repeal 1-11 conflicting laws; and for other purposes. 1-12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-13 Code Section 15-6-2 of the Official Code of Georgia 1-14 Annotated, relating to the number of superior court judges 1-15 for each of the judicial circuits, is amended by striking 1-16 paragraph (11) of said Code section in its entirety and 1-17 inserting in lieu thereof a new paragraph (11) to read as 1-18 follows: 1-19 "(11) Cobb Circuit................................ 7 8". SECTION 2. 1-20 A new judge of the superior court is added to the Cobb 1-21 Judicial Circuit, thereby increasing to eight the number of 1-22 judges of said circuit. SECTION 3. 1-23 The initial judge appointed as provided by this Act shall be 1-24 appointed by the Governor for a term beginning July 1, 1995, 1-25 and expiring December 31, 1996, and until a successor is 1-26 elected and qualified. A successor to the initial judge 1-27 shall be elected in a manner provided by law for the 1-28 election of judges of the superior courts of this state at 1-29 the general election in November, 1996, for a term of four 1-30 years beginning on January 1, 1997, and until the election -1- (Index) LC 22 1342 2- 1 and qualification of a successor. Future successors shall 2- 2 be elected at the general election each four years 2- 3 thereafter for terms of four years and until the election 2- 4 and qualification of a successor. They shall take office on 2- 5 the first day of January following the date of the election. 2- 6 Such elections shall be held and conducted in a manner 2- 7 provided by law for the election of judges of the superior 2- 8 courts of this state. SECTION 4. 2- 9 Said additional judge shall have and may exercise all 2-10 powers, duties, dignity, jurisdiction, privileges, and 2-11 immunities of the present judges of the superior courts of 2-12 this state. Any of the judges of the superior court of said 2-13 circuit may preside over any case therein and perform any 2-14 official act as judge thereof. SECTION 5. 2-15 The compensation, salary, and contingent expense allowance 2-16 of said additional judge shall be the same as that of the 2-17 other judges of the superior court of the Cobb Judicial 2-18 Circuit. Any salary supplements paid by the county of said 2-19 circuit shall also be applicable to the additional judge 2-20 provided for in this Act. SECTION 6. 2-21 All laws and parts of laws in conflict with this Act are 2-22 repealed. -2- (Index)
