A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 47-3-21 of the Official Code of
1- 2 Georgia Annotated, relating to the creation and membership
1- 3 of the board of trustees of the Teachers Retirement System
1- 4 of Georgia, so as to change the terms of such trustees from
1- 5 three to six years; to provide for currently serving
1- 6 trustees; to repeal conflicting laws; and for other
1- 7 purposes.
1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 9 Code Section 47-3-21 of the Official Code of Georgia
1-10 Annotated, relating to the creation and membership of the
1-11 board of trustees of the Teachers Retirement System of
1-12 Georgia, is amended by striking in its entirety subsection
1-13 (a) and inserting in lieu thereof the following:
1-14 "(a) There is created a board of trustees which shall
1-15 consist of ten trustees as follows:
1-16 (1) The state auditor, ex officio;
1-17 (2) One member who shall be an active member of the
1-18 Teachers Retirement System of Georgia who is a classroom
1-19 teacher and is not an employee of the Board of Regents
1-20 of the University System of Georgia. The member serving
1-21 in this position on July 1, 1995, shall continue to
1-22 serve until June 30, 1997. Thereafter, such Such member
1-23 shall be appointed by the Governor for a term of three
1-24 six years with the initial term beginning April 1, 1991
1-25 July 1, 1997. In making the appointment, the Governor
1-26 may consider, but not be limited to, nominations
1-27 furnished him or her by the nominating committee
1-28 provided for by subsection (g) of this Code section;
1-29 (3) The director of the Office of Treasury and Fiscal
1-30 Services, ex officio;
1-31 (4) One member who shall be an active member of the
1-32 Teachers Retirement System of Georgia who is a classroom

2- 1 teacher and not an employee of the Board of Regents of
2- 2 the University System of Georgia. The member serving in
2- 3 this position on July 1, 1995, shall serve until June
2- 4 30, 1996. Thereafter, such Such member shall be
2- 5 appointed by the Governor for a term of three six years
2- 6 with the initial term beginning July 1, 1984 1996. In
2- 7 making the appointment the Governor may consider, but
2- 8 not be limited to, nominations furnished him or her by
2- 9 the nominating committee provided for by subsection (g)
2-10 of this Code section;
2-11 (5) One member who shall be an active member of the
2-12 Teachers Retirement System of Georgia who is a school
2-13 administrator and not an employee of the Board of
2-14 Regents of the University System of Georgia. Such
2-15 member shall be appointed by the Governor for a term of
2-16 three six years with the initial term beginning July 1,
2-17 1986 1995. In making the appointment the Governor may
2-18 consider, but not be limited to, nominations furnished
2-19 him or her by the nominating committee provided for by
2-20 subsection (g) of this Code section. The trustee
2-21 occupying the 'school administrator' position on the
2-22 board of trustees on July 1, 1984, and a prior
2-23 appointment by the Governor shall continue to serve in
2-24 this position from July 1, 1984, until July 1, 1986;
2-25 (6) One member who shall be an active member of the
2-26 Teachers Retirement System of Georgia who is not an
2-27 employee of the Board of Regents of the University
2-28 System of Georgia. The member serving in this position
2-29 shall continue to serve until June 30, 1998.
2-30 Thereafter, such Such member shall be appointed by the
2-31 Governor for a term of three six years with the initial
2-32 term beginning July 1, 1985 1998. In making the
2-33 appointment the Governor may consider, but not be
2-34 limited to, nominations furnished him or her by the
2-35 nominating committee provided for by subsection (g) of
2-36 this Code section. Prior to July 1, 1984, the trustees
2-37 holding office under immediately preceding law and prior
2-38 appointments by the Governor shall elect a person to
2-39 occupy this position on the board of trustees from July
2-40 1, 1984, until July 1, 1985;
2-41 (7) One member who shall be an active member of the
2-42 Teachers Retirement System of Georgia who is an employee
2-43 of the Board of Regents of the University System of
2-44 Georgia and who shall be appointed by the board of

3- 1 regents for a term of three six years with the initial
3- 2 term beginning July 1, 1985 1999. The trustee occupying
3- 3 the 'employee of the board of regents' position on the
3- 4 board of trustees on July 1, 1984 1995, and a prior
3- 5 appointment by the board of regents shall continue to
3- 6 serve in this position from July 1, 1984, until July 1,
3- 7 1985 1999;
3- 8 (8) One member to be appointed by the Governor for a
3- 9 term of three six years with the initial term beginning
3-10 July 1, 1984 2000. The member serving in this position
3-11 on July 1, 1995, shall continue to serve until June 30,
3-12 2000;
3-13 (9) One member who has retired under the Teachers
3-14 Retirement System of Georgia and who shall be elected by
3-15 the remaining trustees for a term of three six years
3-16 with the initial term beginning July 1, 1985 1997. The
3-17 trustee occupying the 'retired teacher' position on the
3-18 board of trustees on July 1, 1984 1995, and a prior
3-19 appointment by the Governor shall continue to serve in
3-20 this position from July 1, 1984, until July 1, 1985 June30, 1997; and
3-22 (10) The tenth trustee shall be a citizen of Georgia,
3-23 not a member of the Teachers Retirement System of
3-24 Georgia, who shall be experienced in the investment of
3-25 moneys and who shall be elected by the remaining
3-26 trustees for a term of three six years with the initial
3-27 term beginning July 1, 1984 1996. The member serving in
3-28 this position on July 1, 1995, shall continue to serve
3-29 until June 30, 1996."
SECTION 2.
3-30 All laws and parts of laws in conflict with this Act are
3-31 repealed.
