A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 1 of Chapter 10 of Title 15 of the Official
1- 2 Code of Georgia Annotated, relating to general provisions
1- 3 regarding magistrate courts, so as to provide for the
1- 4 monetary jurisdiction of civil claims in magistrate court to
1- 5 be set at $7,500.00; to repeal conflicting laws; and for
1- 6 other purposes.
1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 8 Article 1 of Chapter 10 of Title 15 of the Official Code of
1- 9 Georgia Annotated, relating to general provisions regarding
1-10 magistrate courts, is amended by striking in its entirety
1-11 paragraph (5) of Code Section 15-10-2, relating to the
1-12 monetary jurisdiction of civil claims, and inserting in lieu
1-13 thereof a new paragraph (5) to read as follows:
1-14 "(5) The trial of civil claims including garnishment and
1-15 attachment in which exclusive jurisdiction is not vested
1-16 in the superior court and the amount demanded or the
1-17 value of the property claimed does not exceed $5,000.00
1-18 $7,500.00, provided that no prejudgment attachment may
1-19 be granted;".
SECTION 2.
1-20 All laws and parts of laws in conflict with this Act are
1-21 repealed.
