HB 47 LC 14 6335 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 33-23-1 of the Official Code of 1- 2 Georgia Annotated, relating to definitions of terms 1- 3 applicable to licensing of insurance agents, subagents, 1- 4 counselors, and adjusters, so as to provide that the term 1- 5 "adjuster" does not include a salaried employee of an 1- 6 insurer who adjusts claims; to provide for related matters; 1- 7 to repeal conflicting laws; and for other purposes. 1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 9 Code Section 33-23-1 of the Official Code of Georgia 1-10 Annotated, relating to definitions of terms applicable to 1-11 licensing of insurance agents, subagents, counselors, and 1-12 adjusters, is amended by striking paragraph (1) of 1-13 subsection (a) and inserting in its place the following: 1-14 "(1) 'Adjuster' means any person who for a fee, 1-15 commission, salary, or other compensation investigates, 1-16 settles, or adjusts and reports to his or her employer 1-17 or principal with respect to claims arising under 1-18 insurance contracts on behalf of the insurer or the 1-19 insured or a person who directly supervises or manages 1-20 such person. The term 'adjuster' does not include: 1-21 (A) Persons who adjust claims arising under contracts 1-22 of life or marine insurance or annuities; or 1-23 (B) An agent or a salaried employee of an agent or a 1-24 salaried employee of an insurer who adjusts or assists 1-25 in adjusting losses under policies issued by such 1-26 agent or insurer." SECTION 2. 1-27 All laws and parts of laws in conflict with this Act are 1-28 repealed. -1- (Index)
