HB 500 HB 500/AP H. B. No. 500 (AS PASSED HOUSE AND SENATE) By: Representatives Sherrill of the 62nd, Smith of the 175th, Coleman of the 80th, Walker of the 141st, Taylor of the 134th and others A BILL TO BE ENTITLED AN ACT 1- 1 To amend Chapter 2 of Title 20 of the Official Code of 1- 2 Georgia Annotated, relating to elementary and secondary 1- 3 education, so as to provide for an additional special 1- 4 education category; to provide for the program weight for 1- 5 such additional program; to repeal conflicting laws; and for 1- 6 other purposes. 1- 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 8 Chapter 2 of Title 20 of the Official Code of Georgia 1- 9 Annotated, relating to elementary and secondary education, 1-10 is amended by striking subsection (d) of Code Section 1-11 20-2-152, relating to special education services, and 1-12 inserting in its place a new subsection (d) to read as 1-13 follows: 1-14 "(d) For purposes of funding under this article, the 1-15 following special education categories are authorized for 1-16 the local units of administration of this state: 1-17 (1) Category I: self-contained specific learning 1-18 disabled and self-contained speech-language disordered; 1-19 (2) Category II: mildly mentally disabled; 1-20 (3) Category III: behavior disordered, moderately 1-21 mentally disabled, severely mentally disabled, resourced 1-22 specific learning disabled, resourced speech-language 1-23 disordered, self-contained hearing impaired and deaf, 1-24 self-contained orthopedically disabled, and 1-25 self-contained other health impaired; 1-26 (4) Category IV: deaf-blind, profoundly mentally 1-27 disabled, visually impaired and blind, resourced hearing 1-28 impaired and deaf, resourced orthopedically disabled, 1-29 and resourced other health impaired; and 1-30 (5) Category V: those special education students 1-31 classified as being in Categories I through IV, as H. B. No. 500 -1- (Index) HB 500/AP 2- 1 defined in this subsection whose Individualized 2- 2 Educational Programs specify specially designed 2- 3 instruction or supplementary aids or services in 2- 4 alternative placements, in the least restrictive 2- 5 environment, including the regular classroom and who 2- 6 receive such services from personnel such as 2- 7 paraprofessionals, interpreters, job coaches, and other 2- 8 assistive personnel; and 2- 9 (5)(6) Category V VI: intellectually gifted."
