HB 513 LC 9 8223S A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 4 of Chapter 11 of Title 16 of the Official 1- 2 Code of Georgia Annotated, relating to dangerous 1- 3 instrumentalities and practices, so as to declare that the 1- 4 regulation of firearms is properly an issue of general, 1- 5 state-wide concern; to prohibit the regulation of firearms, 1- 6 firearms dealers, dealers in firearms components, and gun 1- 7 shows by counties or municipal corporations; to provide for 1- 8 exceptions; to prohibit the enactment or adoption of certain 1- 9 ordinances or regulations; to provide that certain county 1-10 and municipal ordinances and regulations shall be void and 1-11 no longer of force and effect after a certain date; to 1-12 provide for other matters relative to the foregoing; to 1-13 provide an effective date; to repeal conflicting laws; and 1-14 for other purposes. 1-15 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-16 Article 4 of Chapter 11 of Title 16 of the Official Code of 1-17 Georgia Annotated, relating to dangerous instrumentalities 1-18 and practices, is amended by adding at the end thereof a new 1-19 Part 5 to read as follows: "Part 5 1-20 16-11-170. (Index) 1-21 (a) It is declared by the General Assembly that the 1-22 regulation of firearms is properly an issue of general, 1-23 state-wide concern. 1-24 (b) Except as provided in this Code section, no county or 1-25 municipal corporation, by zoning or by ordinance, 1-26 resolution, or other enactment, shall regulate in any 1-27 manner gun shows, the possession, ownership, transport, 1-28 carrying, transfer, sale, purchase, licensing, or 1-29 registration of firearms, components of firearms, firearms 1-30 dealers, or dealers in firearms components. -1- (Index) LC 9 8223S 2- 1 (c) A county or municipal corporation may regulate the 2- 2 transport, carrying, or possession of firearms by 2- 3 employees of the local unit of government in the course of 2- 4 their employment with that local unit of government. 2- 5 (d) Nothing contained in this Code section shall prohibit 2- 6 municipalities or counties, by ordinance, resolution, or 2- 7 other enactment, from requiring the ownership of guns by 2- 8 heads of households within the political subdivision. 2- 9 (e) Nothing contained in this Code section shall prohibit 2-10 municipalities or counties, by ordinance, resolution, or 2-11 other enactment, from reasonably limiting or prohibiting 2-12 the discharge of firearms within the boundaries of the 2-13 municipal corporation. 2-14 (f) No county or municipal ordinance or regulation which 2-15 was in effect on July 1, 1995, except those ordinances or 2-16 regulations which may be adopted pursuant to subsection 2-17 (c), (d), or (e) of this Code section, shall be of further 2-18 force and effect on or after July 1, 1995. No ordinance 2-19 or regulation attempting to regulate firearms in any 2-20 manner, except as authorized by subsection (c), (d), or 2-21 (e) of this Code section, shall be enacted or adopted by 2-22 any county or municipal corporation on or after July 1, 2-23 1995." SECTION 2. 2-24 This Act shall become effective on July 1, 1995. SECTION 3. 2-25 All laws and parts of laws in conflict with this Act are 2-26 repealed. -2- (Index)
