A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Code Section 40-5-1 of the Official Code of Georgia
1- 2 Annotated, relating to definitions relative to drivers'
1- 3 licenses, so as to change the definition of the term
1- 4 "resident"; to repeal conflicting laws; and for other
1- 5 purposes.
1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 7 Code Section 40-5-1 of the Official Code of Georgia
1- 8 Annotated, relating to definitions relative to drivers'
1- 9 licenses, is amended by striking in its entirety paragraph
1-10 (15) and inserting in lieu thereof the following:
1-11 "(15) 'Resident' means a person who has a permanent home
1-12 or abode in Georgia to which, whenever such person is
1-13 absent, he or she has the intention of returning. For
1-14 the purposes of this chapter, there is a rebuttable
1-15 presumption that the following person is a resident:
1-16 (A) Any person who accepts employment or engages in
1-17 any trade, profession, or occupation in Georgia or
1-18 enters his or her children to be educated in the
1-19 public schools of Georgia within ten days after the
1-20 commencement of such employment or education; or
1-21 (B) Any person who, except for infrequent, brief
1-22 absences, has been present in the state for 30 or more
1-23 days;
1-24 provided, however, that no person shall be considered a
1-25 resident for purposes of this chapter unless such person
1-26 is either a United States citizen, resident alien, an
1-27 alien with U.S. Immigration and Naturalization Service
1-28 employment authorization or an alien presumed to be
1-29 residing in the United States under color of law or an
1-30 alien with legal authorization from the U.S. Immigration
1-31 and Naturalization Service."

SECTION 2.
2- 1 All laws and parts of laws in conflict with this Act are
2- 2 repealed.
