HB 569 LC 9 8124 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Article 3 of Chapter 9 of Title 24 of the Official 1- 2 Code of Georgia Annotated, relating to examination of 1- 3 witnesses generally, so as to change the provisions relating 1- 4 to the admissibility and examination of experts; to repeal 1- 5 conflicting laws; and for other purposes. 1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 7 Article 3 of Chapter 9 of Title 24 of the Official Code of 1- 8 Georgia Annotated, relating to examination of witnesses 1- 9 generally, is amended by striking Code Section 24-9-67, 1-10 relating to admissibility and examination of experts, and 1-11 inserting in lieu thereof a new Code Section 24-9-67 to read 1-12 as follows: 1-13 "24-9-67. (Index) 1-14 (a) The opinions of experts on any question of science, 1-15 skill, trade, or like questions shall always be 1-16 admissible.; and such opinions may be given on the facts 1-17 as proved by other witnesses. 1-18 (b) The facts or data in the particular case upon which an 1-19 expert bases an opinion or inference may be those 1-20 perceived by or made known to the expert at or before the 1-21 hearing. If of a type reasonably relied upon by experts 1-22 in a particular field in forming opinions or inferences 1-23 upon the subject, the facts or data need not be admissible 1-24 in evidence. 1-25 (c) The expert may testify in terms of opinion or 1-26 inference and give reasons therefor without first 1-27 testifying to or being hypothetically informed of the 1-28 underlying facts or data, unless the court requires 1-29 otherwise. The expert may in any event be required to 1-30 disclose the underlying facts or data on 1-31 cross-examination." -1- (Index) LC 9 8124 SECTION 2. 2- 1 All laws and parts of laws in conflict with this Act are 2- 2 repealed. -2- (Index)
