A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 4 of Chapter 11 of Title 16 of the Official
1- 2 Code of Georgia Annotated, relating to criminal offenses
1- 3 involving dangerous instrumentalities and practices, so as
1- 4 to provide that it shall be unlawful to sell, distribute, or
1- 5 possess armor-piercing ammunition; to define a term; to
1- 6 provide for criminal punishment; to provide for enhanced
1- 7 punishment for a violation by a previously convicted felon;
1- 8 to provide for related matters; to repeal conflicting laws;
1- 9 and for other purposes.
1-10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-11 Article 4 of Chapter 11 of Title 16 of the Official Code of
1-12 Georgia Annotated, relating to criminal offenses involving
1-13 dangerous instrumentalities and practices, is amended by
1-14 adding a new Part 5 to read as follows:
"Part 5
1-15 16-11-170. (Index)
1-16 (a) As used in this Code section, the term 'armor-piercing
1-17 ammunition' means any ammunition for any handgun, rifle,
1-18 or shotgun which is:
1-19 (1) Designed for the purpose of;
1-20 (2) Held out by the manufacturer or distributor as; or
1-21 (3) Generally recognized as
1-22 having a specialized capability to penetrate any type of
1-23 body armor which is usually and customarily worn by all or
1-24 any of the personnel of any law enforcement agency in this
1-25 state.
1-26 (b) It shall be unlawful for any person to sell,
1-27 distribute, or possess any armor-piercing ammunition in
1-28 this state.

2- 1 (c) Any person who violates this Code section shall upon
2- 2 conviction be guilty of a misdemeanor, except that any
2- 3 person who is on probation as a first offender pursuant to
2- 4 Article 3 of Chapter 8 of Title 42 or who has been
2- 5 convicted of a felony by a court of this state or any
2- 6 other state; by a court of the United States including its
2- 7 territories, possessions, and dominions; or by a court of
2- 8 any foreign nation and who violates this Code section
2- 9 commits a felony and, upon conviction thereof, shall be
2-10 imprisoned for not less than one nor more than five
2-11 years."
SECTION 2.
2-12 All laws and parts of laws in conflict with this Act are
2-13 repealed.
