A BILL TO BE ENTITLED
AN ACT
1- 1 To amend an Act creating a new charter for the City of
1- 2 Garden City, approved April 17, 1973 (Ga. L. 1973, p. 3581),
1- 3 as amended, so as to increase the limit of the authority of
1- 4 the recorder's court to impose terms of imprisonment and
1- 5 community service from 90 days to 12 months; to increase
1- 6 from 90 days to 12 months the maximum term of imprisonment
1- 7 or community service for violations of the provisions of the
1- 8 charter of Garden City, Georgia, as amended, for which no
1- 9 term of imprisonment or community service is specifically
1-10 provided in said charter; to provide for related matters; to
1-11 repeal conflicting laws; and for other purposes.
1-12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1-13 An Act creating a new charter for the City of Garden City,
1-14 approved April 17, 1973 (Ga. L. 1973, p. 3581), as amended,
1-15 is amended by striking subsection (a) of Article IV, Section
1-16 4.13 and inserting in lieu thereof a new subsection (a) to
1-17 read as follows:
1-18 "(a) Recorder's court shall try and punish for crimes
1-19 against Garden City and for violations of its ordinances.
1-20 The recorder's court shall have authority to punish those
1-21 in its presence for contempt, provided that such a
1-22 punishment shall not exceed $500.00 or ten days in the
1-23 jail. The recorder's court may fix punishment for
1-24 offenses within its jurisdiction not exceeding a fine of
1-25 $1,000.00 or imprisonment for 12 months, or both, and as
1-26 an alternative to a fine or imprisonment, to sentence any
1-27 offender upon conviction to community service for a period
1-28 not exceeding 12 months. Persons sentenced to
1-29 imprisonment may be taken to a confinement or correctional
1-30 facility of either Garden City or Chatham County."

SECTION 2.
2- 1 Said Act is further amended by striking Article VIII,
2- 2 Section 8.13 and inserting in lieu thereof a new Section
2- 3 8.13 to read as follows:
2- 4 "SECTION 8.13.
Penalties.
2- 5 The violation of any provision of this charter for which
2- 6 no penalty is specifically provided for herein is declared
2- 7 to be a misdemeanor and shall be punishable by a fine of
2- 8 not more than $1,000.00 or imprisonment not to exceed 12
2- 9 months, or both such fine and imprisonment, or, as an
2-10 alternative to a fine or imprisonment, by a sentence of
2-11 community service for a period not exceeding 12 months."
SECTION 3.
2-12 All laws and parts of laws in conflict with this Act are
2-13 repealed.
