A BILL TO BE ENTITLED
AN ACT
1- 1 To amend Article 7 of Chapter 10 of Title 9 of the Official
1- 2 Code of Georgia Annotated, relating to continuances, so as
1- 3 to provide for grounds for continuance for the presiding of
1- 4 a party or attorney as a judge or recorder in another court;
1- 5 to provide an effective date; to repeal conflicting laws;
1- 6 and for other purposes.
SECTION 1.
1- 7 Article 7 of Chapter 10 of Title 9 of the Official Code of
1- 8 Georgia Annotated, relating to continuances, is amended by
1- 9 adding a new Code section immediately following Code Section
1-10 9-10-150 to be designated Code Section 9-10-150.1, to read
1-11 as follows:
1-12 "9-10-150.1. (Index)
1-13 It shall be the duty of the judge of any trial court of
1-14 this state to continue, on or without motion, any case in
1-15 the court when any party thereto or such party's attorney
1-16 shall, when the case is reached, be absent from the court
1-17 by reason of such party's presiding as a judge or recorder
1-18 in another court or if lead counsel in such case shall be
1-19 absent, by reason of his or her service presiding as a
1-20 judge or recorder in another court. Any such continuance
1-21 shall last during the entire length of the term of such
1-22 other court, unless the party, in the absence of the
1-23 party's attorney, or the attorney, in the absence of the
1-24 party, shall, on the call of the case, announce ready for

1-26 attorneys engaged by a party, a continuance shall be
1-27 granted upon a showing by the party or the other counsel
1-28 that the absent counsel is necessary or desirable for the
1-29 proper handling of the case."
SECTION 2.
1-30 This Act shall become effective upon its approval by the
1-31 Governor or upon its becoming law without such approval.

2- 1 All laws and parts of laws in conflict with this Act are
2- 2 repealed.
