HB 689 LC 11 8541 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 47-2-262 of the Official Code of 1- 2 Georgia Annotated, relating to membership in the Employees' 1- 3 Retirement System of Georgia by assistant district attorneys 1- 4 and employees of the Prosecuting Attorneys' Council, so as 1- 5 to change the definition of assistant district attorney; to 1- 6 provide that certain current assistant district attorneys 1- 7 and employees of the Prosecuting Attorneys' Council may 1- 8 elect to become members of the Employees' Retirement System 1- 9 of Georgia; to provide for other matters relative to the 1-10 foregoing; to provide for an effective date and automatic 1-11 repeal; to repeal conflicting laws; and for other purposes. 1-12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-13 Code Section 47-2-262 of the Official Code of Georgia 1-14 Annotated, relating to membership in the Employees' 1-15 Retirement System of Georgia by assistant district attorneys 1-16 and employees of the Prosecuting Attorneys' Council, is 1-17 amended by striking paragraph (1) of subsection (a) of said 1-18 Code section and inserting in lieu thereof a new paragraph 1-19 (1) to read as follows: 1-20 "(1) 'Assistant district attorneys' means assistant 1-21 district attorneys who are compensated from state funds 1-22 pursuant to Code Section 15-18-14 Article 1 of Chapter 1-23 18 of Title 15 relating to district attorneys." SECTION 2. 1-24 Said Code section is further amended by inserting after 1-25 subsection (b) of said Code section a new subsection (c) to 1-26 read as follows: 1-27 "(c) Any assistant district attorney or employee of the 1-28 Prosecuting Attorneys' Council who held such position on 1-29 June 30, 1979, is employed as an assistant district 1-30 attorney or employee of the Prosecuting Attorneys' Council 1-31 on the effective date of this subsection, and is not a -1- (Index) LC 11 8541 2- 1 member of the Employees' Retirement System of Georgia may 2- 2 elect to become a member of the Employees' Retirement 2- 3 System of Georgia as provided in subsection (b) of this 2- 4 Code section and to obtain creditable service for such 2- 5 time as provided in Code Section 47-2-263. Any such 2- 6 employee electing to become a member of the retirement 2- 7 system shall so notify the board of trustees not later 2- 8 than October 1, 1996. Any such employee who fails to 2- 9 notify the board of trustees by that date shall not at any 2-10 time thereafter be eligible for membership in the 2-11 retirement system." SECTION 3. 2-12 This Act shall become effective on July 1, 1996, only if it 2-13 is determined to have been concurrently funded as provided 2-14 in Chapter 20 of Title 47 of the Official Code of Georgia 2-15 Annotated, the "Public Retirement Systems Standards Law"; 2-16 otherwise, this Act shall not become effective and shall be 2-17 automatically repealed in its entirety on July 1, 1996, as 2-18 required by subsection (a) of Code Section 47-20-50. SECTION 4. 2-19 All laws and parts of laws in conflict with this Act are 2-20 repealed. -2- (Index)
