HB 73 LC 21 2893 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 47-4-100 of the Official Code of 1- 2 Georgia Annotated, relating to normal, early, and delayed 1- 3 retirement under the Public School Employees Retirement 1- 4 System, so as to provide that a member of such retirement 1- 5 system may retire upon obtaining 30 years of service without 1- 6 regard to age; to provide for an effective date and 1- 7 automatic repeal; to repeal conflicting laws; and for other 1- 8 purposes. 1- 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-10 Code Section 47-4-100 of the Official Code of Georgia 1-11 Annotated, relating to normal, early, and delayed retirement rtddcoundB {@R@d( {@R@d{@R@dô{@R@dz@R@dêz@R@dÐz 1-13 amended by striking in its entirety subsection (a) and 1-14 inserting in lieu thereof the following: 1-15 "(a) The normal retirement date of a member shall be the 1-16 first day of the month coinciding with or next following 1-17 the date he or she obtains 30 years of creditable service 1-18 or the date he or she reaches the age of 65, whichever 1-19 date is earlier; provided, however, except that the normal 1-20 retirement date of a member who is age 64 or over on 1-21 January 1, 1970, shall be January 1, 1971. A member shall 1-22 retire on his or her normal retirement date except as 1-23 otherwise provided in subsections (b) through (e) of this 1-24 Code section." SECTION 2. 1-25 This Act shall become effective on July 1, 1996, only if it 1-26 is determined to have been concurrently funded as provided 1-27 in Chapter 20 of Title 47 of the Official Code of Georgia 1-28 Annotated, the "Public Retirement Systems Standards Law"; 1-29 otherwise, this Act shall not become effective and shall be 1-30 automatically repealed in its entirety on July 1, 1996, as 1-31 required by subsection (a) of Code Section 47-20-50. -1- (Index) LC 21 2893 SECTION 3. 2- 1 All laws and parts of laws in conflict with this Act are 2- 2 repealed. -2- (Index)
