HB 739 LC 19 2403 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Title 50 of the Official Code of Georgia Annotated, 1- 2 relating to state government, so as to create the Georgia 1- 3 Institute for Community Economic Development; to define 1- 4 terms; to provide for the purposes of the institute; to 1- 5 provide for the powers of the institute; to provide for a 1- 6 director of the institute; to provide for the powers and 1- 7 duties of the director of the institute; to provide that the 1- 8 costs of operating the institute shall be paid from public 1- 9 funds; to assign the institute to the Department of 1-10 Community Affairs for administrative purposes only; to 1-11 designate the Attorney General as legal adviser for the 1-12 director; to provide for related matters; to repeal 1-13 conflicting laws; and for other purposes. 1-14 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-15 Title 50 of the Official Code of Georgia Annotated, relating 1-16 to state government, is amended by adding at the end thereof 1-17 a new Chapter 29 to read as follows: "CHAPTER 29 1-18 50-29-1. (Index) 1-19 As used in this chapter, the term: 1-20 (1) 'Director' means the director of the Georgia 1-21 Institute of Community Economic Development as created 1-22 under this chapter. 1-23 (2) 'Institute' means the Georgia Institute for 1-24 Community Economic Development as created under this 1-25 chapter. 1-26 50-29-2. (Index) 1-27 There is created and established the Georgia Institute of 1-28 Community Economic Development as a body corporate and 1-29 politic, an instrumentality of the state, and a public -1- (Index) LC 19 2403 2- 1 corporation; and by that name the institute may contract 2- 2 and be contracted with and bring and defend actions. 2- 3 50-29-3. (Index) 2- 4 The purposes for which the institute is founded shall 2- 5 include the following: 2- 6 (1) To promote, stimulate, develop, and advance economic 2- 7 growth in undeveloped and economically distressed 2- 8 communities throughout the state and thereby promote, 2- 9 stimulate, develop, and advance the business, 2-10 prosperity, and economic welfare of the entire state; 2-11 (2) To encourage and assist, through loans, grants, 2-12 investments, or other business transactions, in the 2-13 location of small business and industry in this state 2-14 and to rehabilitate and assist existing small business 2-15 and industry in limited resource communities; 2-16 (3) To stimulate and assist in the expansion of all 2-17 kinds of community based small business activity which 2-18 will tend to promote small business development and 2-19 maintain the economic stability of the state; 2-20 (4) To provide maximum opportunities for employment and 2-21 improve the standard of living of the citizens of this 2-22 state; 2-23 (5) To coordinate, at the state level, the existing 2-24 network of economic development entities throughout the 2-25 state; 2-26 (6) To cooperate and act in conjunction with other 2-27 organizations, public or private, in the promotion of 2-28 industrial, commercial, agricultural, and recreational 2-29 small business developments in this state; and 2-30 (7) To provide financing for the promotion, development, 2-31 and conduct of all kinds of community based small 2-32 business activity in the state. 2-33 50-29-4. (Index) 2-34 In furtherance of its purposes, the institute shall have 2-35 the following powers: 2-36 (1) To provide technical advice and assistance for both 2-37 public and private sources of contract opportunities for 2-38 community based small businesses; -2- (Index) LC 19 2403 3- 1 (2) To identify and coordinate partnerships between 3- 2 private enterprise, government, and community based 3- 3 groups to facilitate community revitalization efforts; 3- 4 (3) To assist the Unified Development Council and 3- 5 regional development centers throughout the state in 3- 6 developing five-year plans for economic development 3- 7 initiatives for the poorest regions of this state; 3- 8 (4) To establish rural economic development centers for 3- 9 the purpose of establishing community economic 3-10 development projects; 3-11 (5) To provide grants and loans to community development 3-12 projects and to establish and regulate the terms and 3-13 conditions with respect to such grants and loans; 3-14 (6) To make and execute contracts, lease agreements, and 3-15 all other instruments necessary or convenient to 3-16 exercise the powers of the institute or to further the 3-17 public purposes for which it was created; 3-18 (7) To apply for and to accept any gifts, bequests, or 3-19 grants or loan guarantees or loans of funds or property 3-20 or financial or other aid in any form from the federal 3-21 government or any agency or instrumentality thereof, or 3-22 from the state or any agency or instrumentality thereof, 3-23 or from any other source for any or all of the purposes 3-24 specified in this chapter and to comply, subject to the 3-25 provisions of this chapter, with the terms and 3-26 conditions thereof; 3-27 (8) To contract with state agencies or any local 3-28 government for the use by the institute of any property, 3-29 facilities, or services of the state, or any such state 3-30 agency or local government; 3-31 (9) To fix and collect fees and charges for data or 3-32 other incidental services provided by it to any private 3-33 individual or entity; 3-34 (10) To deposit or invest funds held by it in any state 3-35 depository or in any investment which is authorized for 3-36 the investment of proceeds of state general obligation 3-37 bonds, and to use for its corporate purposes or 3-38 redeposit or reinvest interest earned on such funds; 3-39 (11) To exercise any power granted by the laws of this 3-40 state to public or private corporations which is not in 3-41 conflict with the public purpose of the institute; and -3- (Index) LC 19 2403 4- 1 (12) To do all things necessary or convenient to carry 4- 2 out the powers conferred by this chapter. 4- 3 50-29-5. (Index) 4- 4 (a) The institute shall be under the direction and 4- 5 supervision of a director who shall be appointed by the 4- 6 Governor. 4- 7 (b) The director shall have the following powers and 4- 8 duties: 4- 9 (1) To maintain an office in the City of Atlanta and 4-10 such other offices within the state as the director may 4-11 deem necessary; 4-12 (2) To appoint assistants, clerks, and other employees 4-13 as the director may deem necessary and to fix their 4-14 compensation; 4-15 (3) To cooperate with individuals and with state, local, 4-16 and other agencies, both public and private, and to 4-17 obtain upon request and utilize the services of all 4-18 governmental departments and agencies; 4-19 (4) To accept gifts, bequests, grants, or other public 4-20 or private payments on behalf of the state and to pay 4-21 such moneys into the state treasury; 4-22 (5) To furnish technical advice and assistance with 4-23 respect to community economic development to further the 4-24 purposes of this chapter; 4-25 (6) To render written reports to the Governor and the 4-26 General Assembly. The reports may contain 4-27 recommendations of the director for legislative or other 4-28 action to effectuate the purposes of this chapter; 4-29 (7) To act as a liaison between community based groups, 4-30 small and minority businesses, government agencies, 4-31 community development corporations, and the private 4-32 sector; and 4-33 (8) To require from any state agency or department such 4-34 reports and information at such times as it may deem 4-35 reasonably necessary to carry out the purposes of this 4-36 chapter. -4- (Index) LC 19 2403 5- 1 50-29-6. (Index) 5- 2 (a) All costs of operating and conducting the institute 5- 3 shall be paid from public funds appropriated for such 5- 4 purposes. 5- 5 (b) The institute shall be assigned to the Department of 5- 6 Community Affairs for administrative purposes only, 5- 7 pursuant to Code Section 50-4-3. 5- 8 (c) The Attorney General shall be the legal adviser for 5- 9 the director." SECTION 2. 5-10 All laws and parts of laws in conflict with this Act are 5-11 repealed. -5- (Index)
