HB 869 LC 10 1261 A BILL TO BE ENTITLED AN ACT 1- 1 To provide a homestead exemption from all City of Warner 1- 2 Robins ad valorem taxes for any city purposes, including but 1- 3 not limited to taxes to retire bonded indebtedness, in the 1- 4 amount of $20,000.00 of the assessed value of the homestead 1- 5 for certain persons who have been residents of the City of 1- 6 Warner Robins for at least the immediately preceding five 1- 7 years and who are 65 years of age or over; to provide for an 1- 8 exception with respect to land in excess of one acre; to 1- 9 specify the terms and conditions of the exemption and the 1-10 procedures relating thereto; to provide for applicability; 1-11 to repeal a specific Act; to provide for a referendum; to 1-12 provide effective dates; to repeal conflicting laws; and for 1-13 other purposes. 1-14 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1-15 For the purpose of this Act, the term "senior citizen" means 1-16 a resident of the City of Warner Robins who has been a 1-17 resident of said city for at least five years immediately 1-18 preceding the first day of a taxable year for which an 1-19 exemption is claimed under this Act and who is 65 years of 1-20 age or over. SECTION 2. 1-21 Each senior citizen is granted an exemption on that person's 1-22 homestead from all City of Warner Robins ad valorem taxes 1-23 for any city purposes, including but not limited to taxes to 1-24 retire bonded indebtedness, in the amount of $20,000.00 of 1-25 the assessed value of that resident's homestead, as defined 1-26 and qualified in Code Section 48-5-40 of the O.C.G.A., 1-27 except that land which is included in that homestead and 1-28 which exceeds one acre shall not have the value thereof 1-29 exempt under this Act. -1- (Index) LC 10 1261 SECTION 3. 2- 1 The governing authority of the City of Warner Robins or its 2- 2 designee shall provide certificate and application forms for 2- 3 the exemption granted by this Act and shall require with the 2- 4 initial application an affidavit by the owner as to the age 2- 5 of the owner and such other information as may be necessary 2- 6 to determine the eligibility of the owner for the exemption. SECTION 4. 2- 7 The exemption granted by this Act shall be claimed and 2- 8 returned as provided in Code Section 48-5-50.1 of the 2- 9 O.C.G.A., except that any applicant seeking an exemption 2-10 under this Act shall file a written application therefor on 2-11 or before the 30th day of June of the year in which such 2-12 exemption is sought. SECTION 5. 2-13 After any such owner has filed the proper affidavit as 2-14 provided in this Act, and has been allowed the exemption 2-15 provided in this Act, it shall not be necessary that he or 2-16 she make application and file such affidavit and certificate 2-17 for any year thereafter and such exemption shall continue to 2-18 be allowed to such owner. It shall be the duty of any 2-19 resident of the City of Warner Robins who has claimed the 2-20 homestead exemption provided for in this Act to notify the 2-21 governing authority of the City of Warner Robins or its 2-22 designee in the event he or she becomes ineligible for any 2-23 reason to receive such homestead exemption. SECTION 6. 2-24 The exemption granted by this Act shall be in lieu of and 2-25 not in addition to any other homestead exemption from City 2-26 of Warner Robins ad valorem taxes. SECTION 7. 2-27 The exemption granted by this Act shall apply to all taxable 2-28 years beginning after December 31, 1995. SECTION 8. 2-29 The exemption granted by this Act shall not apply to or 2-30 affect any county taxes for county purposes, county school 2-31 district taxes for educational purposes, or state taxes. -2- (Index) LC 10 1261 SECTION 9. 3- 1 An Act providing a homestead exemption from all City of 3- 2 Warner Robins ad valorem taxes for any city purposes, 3- 3 including but not limited to taxes to retire bonded 3- 4 indebtedness, in the amount of $8,000.00 of the assessed 3- 5 value of the homestead for certain persons who have been 3- 6 residents of the City of Warner Robins for at least the 3- 7 immediately preceding five years and who are 62 years of age 3- 8 or over in 1994, 63 years of age or over in 1995, 64 years 3- 9 of age or over in 1996, and 65 years of age or over in 1997 3-10 and thereafter, approved March 24, 1994 (Ga. L. 1994, p. 3-11 3707), and ratified on September 20, 1994, is hereby 3-12 repealed in its entirety. SECTION 10. 3-13 Unless prohibited by the federal Voting Rights Act of 1965, 3-14 as amended, the election superintendent of the City of 3-15 Warner Robins shall call and conduct an election as provided 3-16 in this section for the purpose of submitting this Act to 3-17 the electors of the City of Warner Robins for approval or 3-18 rejection. The election superintendent shall conduct that 3-19 election on the Tuesday next following the first Monday in 3-20 November, 1995, and shall issue the call therefor not less 3-21 than 30 nor more than 60 days prior to the date of that 3-22 election. The superintendent shall cause the date and 3-23 purpose of the election to be published once a week for two 3-24 weeks immediately preceding the date thereof in the official 3-25 organ of Houston County. The ballot shall have written or 3-26 printed thereon the words: 3-27 "( ) YES Shall the Act be approved which provides a 3-28 homestead exemption from all City of Warner 3-29 ( ) NO Robins ad valorem taxes for any city purposes 3-30 in the amount of $20,000.00 of the assessed 3-31 value of the homestead of certain persons who 3-32 have been residents of the city for at least 3-33 five years and who are 65 years of age or 3-34 over?" 3-35 All persons desiring to vote for approval of the Act shall 3-36 vote "Yes," and those persons desiring to vote for rejection 3-37 of the Act shall vote "No." If more than one-half of the 3-38 votes cast on such question are for approval of the Act, 3-39 then Sections 1 through 9 of this Act shall become of full 3-40 force and effect immediately. If Sections 1 through 9 of 3-41 this Act are not so approved or if the election is not -3- (Index) LC 10 1261 4- 1 conducted as provided in this section, this Act shall not 4- 2 become effective and this Act shall be automatically 4- 3 repealed on the first day of January immediately following 4- 4 that election date. 4- 5 The expense of such election shall be borne by the City of 4- 6 Warner Robins. It shall be the superintendent's duty to 4- 7 certify the result thereof to the Secretary of State. SECTION 11. 4- 8 Except as otherwise provided in Section 10 of this Act, this 4- 9 Act shall become effective upon its approval by the Governor 4-10 or upon its becoming law without such approval. SECTION 12. 4-11 All laws and parts of laws in conflict with this Act are 4-12 repealed. -4- (Index)
