HB 890 LC 24 0156 A BILL TO BE ENTITLED AN ACT 1- 1 To amend Code Section 12-3-3 of the Official Code of Georgia 1- 2 Annotated, relating to powers of the Department of Natural 1- 3 Resources regarding parks and recreation projects, so as to 1- 4 provide that certain additional property may be subleased 1- 5 for private development and operation of park facilities; to 1- 6 provide for related matters; to repeal conflicting laws; and 1- 7 for other purposes. 1- 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA: SECTION 1. 1- 9 Code Section 12-3-3 of the Official Code of Georgia 1-10 Annotated, relating to powers of the Department of Natural 1-11 Resources regarding parks and recreation projects, is 1-12 amended by striking paragraph (10) of subsection (b) and 1-13 inserting in lieu thereof a new paragraph (10) to read as 1-14 follows: 1-15 "(10) Notwithstanding the provisions of any other law, 1-16 including the provisions of paragraph (2) of this 1-17 subsection and the provisions of Article 2 of Chapter 16 1-18 of Title 50, the 'State Properties Code,' the 1-19 commissioner of natural resources is authorized to 1-20 sublease the Park Marina property on Lake Allatoona at 1-21 Red Top Mountain State Park, Bartow County, Georgia;, 1-22 and the Beaverdam Marina property on Richard B. Russell 1-23 Lake, Elbert County, Georgia,; and the Maple Creek site 1-24 on West Point Lake, Troup County, Georgia, for terms 1-25 which coincide with the primary leases between the State 1-26 of Georgia and the United States Army Corps of 1-27 Engineers; provided, however, that said subleases are 1-28 approved by the primary lessor, the United States Army 1-29 Corps of Engineers." SECTION 2. 1-30 All laws and parts of laws in conflict with this Act are 1-31 repealed. -1- (Index)
