A BILL TO BE ENTITLED
AN ACT
1- 1 To amend an Act providing a new charter for the City of
1- 2 Dawson, approved March 21, 1970 (Ga. L. 1970, p. 3121), as
1- 3 amended, so as to change the penalty for contempt in the
1- 4 municipal court; to repeal conflicting laws; and for other
1- 5 purposes.
1- 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
1- 7 An Act providing a new charter for the City of Dawson,
1- 8 approved March 21, 1970 (Ga. L. 1970, p. 3121), as amended,
1- 9 is amended by striking Section 5-9, relating to the
1-10 limitation upon the punishment for contempt, in its entirety
1-11 and inserting in lieu thereof a new Section 5-9 to read as
1-12 follows:
1-13 "SECTION 5-9.
1-14 Limitation upon punishment for contempt.
1-15 The municipal court shall have the power and authority to
1-16 punish for contempt by fine not exceeding $200.00, or by
1-17 imprisonment in the city jail or guardhouse not exceeding
1-18 ten days, either or both, in the discretion of the
1-19 presiding officer of said court; provided, however, that a
1-20 continuous failure or refusal by any person to obey the
1-21 lawful orders and summonses of said court shall be deemed
1-22 a continuous contempt, and the said court may imprison
1-23 such person until its lawful orders are obeyed."
SECTION 2.
1-24 All laws and parts of laws in conflict with this Act are
1-25 repealed.
